What amount of the personal injury settlement recovered by Petitioner, Weslen Bastien as mother and natural guardian of T.S.J., a minor (“T.S.J.” or “Petitioner”), must be paid to Respondent, Agency for Health Care Administration (“AHCA” or “Agency”), pursuant to section 409.910, Florida Statutes (2019), to fully satisfy the Agency's Medicaid lien totaling $279,299.76.Based on the uncontradicted evidence presented and the pro-rata methodology of proof submitted by Petitioner's experts, ACHA's lien should be reduced to 20% of $376,327.20, or $75,265.44.
