The issue in this case is whether, on December 29, 1997, Respondent, a licensed massage therapist, engaged or offered to engage a client in sexual activity while practicing massage therapy, in violation of Section 480.0485, Florida Statutes, and Rule 61G11-30.001(1)(d), Florida Administrative Code (1997).Department of Health failed to show by clear and convincing evidence that licensee was guilty of sexual misconduct in the practice of massage therapy.
