The issues in this proceeding are whether Respondent, the owner/operator of a family day care home, committed the violations alleged in the Administrative Complaint and, if so, what is the appropriate sanction for those violations.The Department failed to prove by clear and convincing evidence that the child's injuries were inflicted by the operator of a family day care home or that the injuries occurred at the family day care home.
