Also at issue is whether the allegations of the Administrative Complaint constitute an unadopted rule in violation of section 120.57(1)(e)1., Florida Statutes.Peitioner proved by clear and convincing evidence that Respondent operated specified card games in violation of s. 849.086(12), but failed to prove that it allowed persons to work without valid occupational licenses in violation of s. 849.086(6).
