The issues in this matter are whether Respondent, Willine Gracia, operated an assisted living facility without the required license, thereby engaging in unlicensed activity; and, if so, the appropriate penalty.The Agency proved by clear and convincing evidence that Respondent was operating an assisted living facility without the required license thereby engaging in unlicensed activity. An administrative fine should be imposed for each day of noncompliance.
