RECOMMENDED ORDER

Pursuant to notice, the Division of Administrative Hearings by its duly designated Hearing Examiner, K. N. Ayers, held a public hearing on the above matter February 20, 1975, Miami, Florida.

1. By this application Dade County, Florida, through its Public Works Department seeks to modify Permit No. 253.124(8)-164 issued by the Trustees of the Internal Improvement Trust Fund so as to authorize the filling of an additional 1.89 acres along the south side of Rickenbacker Causeway a distance of 25 feet into the waterway. The public beach in this area is eroding, thereby exposing the root system of the trees along the beach. Clean beach sand will be hauled in from another location as opposed to being dredged from offshore and will be spread to restore the recreational beach to its original condition.

   
   

2. In the absence of opposition the evidence need not be further delineated except to say the project is required in the public interest and will not adversely affect the water quality of Biscayne Bay. It is therefore,

RECOMMENDED that the application of Dade County, Florida, to modify Permit No. 253.124(8)-164 be granted so as to authorize the filling of an additional

1.89 acres along the south side of Rickenbacker Causeway as more fully described in the application.
