FINAL ORDER OF DISMISSAL
This cause came on for consideration of Respondent's Motion To Dismiss. As grounds therefore, it is alleged that during the 1992 session the Florida Legislature amended Section 120.52(12), Florida Statutes, eliminating the right of prisoners as defined in Section 944.02(5) to obtain or participate in proceedings under Sections 120.54(4) and (9), and 120.56, Florida Statutes. The effective date of this legislation is July 1, 1992.
The amendment to Section 120.52(12) deleting prisoners from those eligible to challenge rules removes this tribunal's jurisdiction to consider rule challenges initiated by prisoners, and all cases pending at the time statutory jurisdiction was abolished. Griffith v. Florida Parole and Probation Commission, 485 So.2d 818 (Fla. 1986); Rothermel v. Florida Parole and Probation Commission, 441 So.2d 663 (Fla. 1st DCA 1983). Accordingly, it is
ORDERED that Archie D. White's petition to challenge emergency rules 23ER- 1,2,3,4 and 5 be dismissed.
