RECOMMENDED ORDER


Pursuant to notice, an administrative hearing was scheduled before Diane D. Tremor, Hearing Officer with the Division of Administrative Hearings, to commence at 9:30 a.m. on July 26, 1979, in Room 406 of the Pinellas County Judicial Building, St. Petersburg, Florida. The issue for determination at the hearing was whether respondent's license number 586 should be revoked, annulled, withdrawn, suspended or otherwise disciplined for the reasons set forth in the Administrative Complaint dated February 5, 1979.

Prior to the commencement of the hearing, the parties herein, each represented by counsel, entered into the following stipulation:


  1. The respondent pleads guilty to all charges contained in the Administrative Complaint.

  2. The license of the respondent will be suspended for a period of sixty (60) days to begin on August 3, 1979. During said period of suspension, the respondent's office will be closed; however, the respondent will have personnel to answer the telephone and take care of patient records and needs.

  3. The respondent will pay all costs taxable by law in connection with the hearing in the

    approximate amount of $400.00.

  4. The respondent will refund all fees paid to him by patients Emmons and Rich. The respondent will also refund to Mr. Rich his airplane fare from Houston, Texas, in the approximate amount of $700.00.

  5. The respondent will be placed on probation for a period of one (1) year and assures that patient records will be maintained and patient care provided in accordance with Chapter 463

    of the Florida Statutes.

  6. The Administrative Complaint will be dismissed with prejudice.


RECOMMENDATION


Both parties having been represented by counsel for the above stipulation, it is recommended that the Board of Optometry adopt the stipulation as its Final Order.
