If I share my biussiness plan in confidence with someone and 48 hours later they back out only to start the business on their own do I have any re-course?

When you say "in confidence" do you mean they signed a Non-Disclosure and Confidentiality Agreement?
If not, it depends on the Intellectual Property aspects of the plan.
