Mineral rights

My parents have been offered a substantial amt of money for their mineral rights to their land. They declined because the money would disqualify them from their SSI & VA Benefits. The rep told them that they could lose their mineral rights anyway by imminent domain from the gas company. Is this true? They live in Arkansas.

What he told them was not exactly correct. They will not lose their mineral rights by eminent domain, but instead could be "integrated." This means that your parents could be forced to pay a penalty because they didn't reach an agreement on the mineral rights. You DO NOT want to be "integrated." I would suggest that your parents contact an attorney to assist them in this process. Feel free to give my office a call.
