Storage rental

I have payed $80.00 a month on a storage rental for the last 15 months in North Louisiana. I now live in Tx. I paid extra for a climet controlled unit, only to find a couple of months ago my microwave completly runed,my fridg. moldy, pictures stuck to glass a jewerly box warped and mice or rats had chewed thru papers I had stored.

Without thinking I threw my microwave and some other things that were runed away.

I do how ever still have the fridg, jewerly box and runed pictures.

My queston , is the storage company responasable for any damaged done to my thing's.

I was told that the controlled unites would keep them from meldewing.

Crooked Landlord

My landlord is demanding $1400 from my housemates and myself 2 months after the lease is up and we have moved out. He claims we ''left it a mess'' when we left, but it was in better condition than when we received it! This landlord is so two-faced saying everything is ok and then stabbing his tenants in the back, as he has done it before. I feel he is just trying to take advantage of us college students as we don't know the laws and are constantly pre-occupied with financial aid, jobs, and schoolwork. Can he really demand this money after our lease is up and we no longer live there?

Is a landlord obligated by accepting a deposit?

We spoke to landlord (who was on vacation) on the phone, who wanted us to deal with the realtor he used previously, since the current tenants were breaking their lease. Realtor did a credit check, then landlord told us the house was ours if we wanted it, and he would stop showing it when we gave the realtor the security deposit, which we did. He cashed one partial sec. dep. check, but not the second check. Now, two weeks later (after we gave notice where we rent and turned down 2 other rentals), he is lying to us about many things and says he's not sure who he is renting it to. No lease was signed yet since he was on vacation. Is he under any obligation to rent to us by accepting the security? And can we sue him? This has greatly inconvenienced my family since we have 2 small children and noplace to live as of August 1st. Thank you for your input.

Illegal utility shut off in a forclosed house

I am a tentant in a house that is bank owned due to foreclosure. The previous owner was responsible for the utlities,and owes $2,000 at the time of foreclosure. The new owners/ bank gave us a 30 day Notice to Quit dated June 2. The water was shut off on June 3rd. The Health Dept got involved, had a hearing & were unable to resolve the issue. Today, the power got shut off. The property is listed as single family residence yet I live in illegal garage conversion of which Building & Safety & Housing Dept notified new owner they must comply with Order to Comply & convert my unit back ino garage but must evict with relocation assistance. Building & Safety put a hold on Utility Company until the owners comply. I was advised to sue in small claims for the time utilities have been off, but I have no where to go in the meantime. I am not working due to disability .What rights do i have?

Tenant Eviction by Landlord for Reporting Safety Issues

Can a landlord evict a tenant for reporting safety issues to local authorities or letting other tenants know about these safety issues? A neighbor has been reporting numerous safety violations in our building to local authorities. The property manager has been cited for some of these violations but many issues still exist. There was a recent burglary in the building and I found out about it from this tenant, not the property manager. The property manager has done nothing yet to increase the security of the building. This tenant said she received a letter from the property manager asking her to leave.

If me and my roommate are cotenants and she left while still on the lease what should I sue her for, the rent she hasn't paid or the amount it would cost to break the lease.

tennant eviction

After claiming to have had an accident, a current tennant has not paid rent in three months. She claims that she is ready to move to Mississouri which will be funded by The Department of Rehabilitation. I sent a certified letter to her last week advising that she needed to be out no later than July 13, 2008. She called when she received the letter saying she did not know when she could be out as the state budget for California has not yet been signed and the Dept. of Rehab cannot give her a firm date. I called this dept. and was advised that they provide vocational services only and do not financially assist with moving expenses. What are the best legal means to see that she abides by my request to vacate and how does it get enforced?

Expired Lease Roommate Refusing to Move Out - Please Help!

Hello Everyone.

I am living in CA (SoCal) with a terrible roommate. Thank god my lease will expire in AUG 2008. Both of us are on the original lease.

I am planning to MOVE OUT! I never want to see my roommate again. But then my Land Lord tells me that I CAN NOT move out ''fully'' with no rental obligations if my roommate does not move out with me.

I just want to move out when my lease is up (AUG). I thought I DO NOT need to worry about my roommate and his activities. I was thinking my side of the obligations are over.

Is this true!? am I forced to be stuck with my roommate unless he agrees to move out with me or signs a new lease with just his name on it? so I can live free??

Please Help.

Landlord/Tenant Issue- Commercial Lease

Had a commercial lease with 2 partners on lease & myself. PArtner changed the locks on me and denied me entry to the office space. Contacted landlord and advise him of the lock change and requested he contact the other partners and get me a new key ASAP. Over a period of 3 week I called the landlord everyday with no response. I went to the landlords office and requested that I be acccompanied over the office with the landlord so they can attemtp to get me in to the office. At the locaiton, the landlords key did not work as the partners had changed the locks. Landlord told me they would change them back and get me a key. I had landlord sign andd date a witness statement stating the locks has been changed. I continue to contact the landlord to attempt to get a new key. Never happened. I formally resigned off the corp via certified mail to each partner and to the state of FL.

I rec a sumons bc the partners have now skipped out on the lease. Do I have any legal couse to have myself removed from this due to the locks being changed??

sublet drama

I continued paying because my friend was living there and at first I sympathized with her. I wanted to get a new tenant in there to take over my payments so I didn't have to make payments when I wasn't there. The landlord told me I should work it out with my roomates, which I tried and didn't work. But in email form he told me he would do it then contradicted himself by saying he wouldn't show the apartment/my room. My roommate added in an email that if I didn't pay the last couple of months rent she would take me to small claims court for not paying. I have been paying but I can't afford to anymore and I told them that but they won't do anything.

Sublet Nightmare

I have been out of my apartment in Santa Monica for about 6 months now but have continued to pay rent b/c the one roomate is a friend. I cannot afford to pay anymore and my roomates agreed to a subletter but then went back on their decision. I spoke with the landlord via email and he said he would sublet but would not handle showing the apartment to anyone. I don't trust my roomates to get this done in a timely matter and/or respect the perosn moving in. Also my one roomate threatened me with small claims court before a decision was even made.

Leaving a condo after being sold at auction

I was renting a condo paying month to month with no lease agreement. Unknown to me, the condo was foreclosed and sold at auction. The person who bought the condo now wants me out. I am willing to leave, but I would like to know if I have an amount of time legally to stay until I find another place.

Apartment Issues

My husband and I signed a year lease in December, 2007. We were happy when we first moved in, until the summer came. We then noticed that the so called luxury apartment had a bug infestation. Not only were there bugs all outside our apartment, but they were all coming in too. My husband and I have bought bug defense to help the problem, but it hasn't made a difference. We have contacted the manager of the apartment and put in numerous work orders. They have sent pest control people over, but it hasn't solved the problem. These bugs are caused by bad garden keep up and is the apartment managers fault. The bugs have spread all over the apartment complex and is a huge problem. I would like to know if this is a valid reason to break a lease or not. We are being charged 1,000 reletting charge for breaking the lease early. For the past two months, I haven't invited friends over b/c of the embarrassment of this problem. Is this bug infestation a valid reason to break the lease?

harrassment from landlord of senior apt

my friend lives in a senior living apt apt in cloverdale cali . he is continuously harrassed by management regarding his visitors. i was recently visiting him daily for the past few weeks on a few events i spent the night and went to work from his place. he goes to the lake often and returns late sometimes and he keeps late hours ,but is never loud or disruptive to others and he owns one vehicle and there is visiting pkg for visitors .and it appears that the harrassment is due to racism because i am part black lady and he is a part native indian man. i once took a 1/2 hour nap while waiting for him to wake up because it was very early in his vehicle i was returning to him and 2 days ago 6/17/08 .he recieved a notice stating i was seen several times sleeping in his vehicle and that he had visitors longer than allowed ther without permission from mgmt and if he did not get to the office and register for a guest visiting past 5 days approveabe by management within 3 daysor he had to get out. also he cannot have his visistors park in visitors parking. today the manager and his wife pounded on the door and made many accusation with a visitor present .mgmt was rude loud airing disrespect what to do tomorrow is day 3 and th

Security Deposit Question

On May 25th, I gave my landlord notice that I was moving out by May 31 because I was scared for my life. I had a young guy try to break into my house and I spotted him again around my house two days later. On June 1st, my landlord and I did a walk through of the property and I gave her the keys back. She said everything was ok, but that she was going to take my security deposit for June's rent. However, on June 9th I went by the house to pick up mail, and found out she had re-rented the property. Am I entitled to some of my security deposit back?

I posted a question to you on 6-5-08 and really need an answer ASAP as my LL is now said he is going to evict me. My ''Q'' was if my CA LL can tell me that when my 1yr lease ends (7-1-08) my new rent will b 1500 Mo 2 Mo (No mention of deposit) then a Mo later say it 1600 + 1600 dep., then virbal agreement of 1500, then 2 days later tell me 1600 + 1600 dep. pd b4 7-1-08 so 2 hold the apt. I already live in for myself. When I moved in last year LL chose to wave deposit (1000 at d time). Can LL now ask 4 deposit 1 year later? Can he keep changing rent agreement once virbal (w/wittness's) and ask me to pay b4 my lease end n Im pd up to 7-1-08 (I pd rent 1yr in full when moved in)? Now on 6-6-08 LL gives me new rent contract (first written notice of increase) n wants me to pay 1600 dep. by 6-24-08 so 2 hold my own apt. for myself. N that I MUST pay 1600 on 7-1-08 or he evict me. Don't I have right 2 a 30 day ''written'' notice of increase which would have been on 6-6-08 right? What can I do? What are my rights here in CA? PLEASE HELP not much time left!!!!

Once the renter is served with a 30 day notice to terminate tenancy can , or why, would a landlord serve the renter with a 3 day notice to quit 3 weeks after the 30 day notice to terminate was served. Also, must they file an unlawful detainer. Lastly, if the renter files bankruptcy before the 30 day deadline what would happen in regards to having to vacate the property.
