Is this illegal eviction? or something else?

I lived with my husband and 3 stepsons and we were late paying our rent. We were almost near the end of our lease and had just found the new place we were moving. We decided to move 3 hours away to start fresh, and since we had some time left on our lease we figured we could gradually move our belongings because we couldn't afford a uhaul. We were never gone long periods of time, maybe 3 or 4 days at the most. When we came back the final time (the official last day of our lease agreement), the front door of our place was open and there was a large trailor out front. All of our things were thrown in the trailor and our home was empty. I couldnt help but cry when I saw what was missing...even my wedding dress and family photos. We drove to the landlord's office to find there was an eviction hearing for us in one hour. We decided to go to the hearing - which I didn't think could happen without being served. We were heartbroken, because we had come to pay our rent and turn in our keys. The landlord said they thought we had abandoned the property and they had emptied our home a week ago. How could they do that?

Apartment lease

My wife and I are in a law suit against our apartment complex. The landlords have been consistantly harrasing us since the beggining of the suit. Now they are blameing things on us that have NEVER happend, none the less she and I would like to break our lease, however we have a couple lined up to take the lease over or a new one on. So all together I need some advice.

Landlord has precluded its tenant (a restaurant) or any of its cleints, employees, principals, vendors from parking in the spaces in front of and adjacent to the restaurant, under threat of trespass warning and arrest. The lease, in regard to parking, only states that the landlord is responsible for the parking lot. Landlord's attorney states the landlord is not responsible for providing any parking. The tenant/landlord relationship has been for 3 years with the use of the parking lot. Any recourse against landlord (for their attempt to deprive the client of any business) Immediately prior to the Attorney's letter stating this policy, Landlord had the restaurant owner's car towed away to an impound lot during the middle of the afternoon during operating hours

Tenant keeps changing locks

My tenant keeps changing the locks to her apartment. I have asked her for the keys several times, and she says she will give them to me but never does. What can I do? I know my rights are extremely limited as a landlord in New Jersey, and she's obviously aware of this, too. Please help.

Rented 3 bedroom, Informed after 2 bedrooms are usable, can I break lease?

The title says it all, I rented a 3 bedroom apartment, then was informed afterwards by a friend who works for the state board of health that because of state statute 410.400

the third bedroom is not usable. Too small.

Can I break the lease for this reason, we have 6 people total, 4 kids.

The other 2 bedrooms are below the Square footage required for 3 people as well.

from February 2007 to August 2008 I lived with my girlfriend in HER apartment (her lease). On August 10, 2008 she threw me out and is holding all of my belongings randsom for money she believes is owed to her. Can she legally do this? If not, what recourse do I have ro retrieve my belongings?

I am on the Section 8 program in California, I moved into my house before the contract was finished with section 8, which leaves me to pay the owner back rent, i have lost my job and am now on welfare, i have not had any success with getting any child support help for my 2 kids, I have told the landlord that i just do not have extra money to start making payments on the back rent not until i can find a job again but everyday she is calling me and asking me when am i going to start paying her the back rent, I am still unemployeed and going to school to try and help me get a job i have applied everywhere fast-food places anything to get more money to help me pay her and to help take care of my childeren and me. She does not care i feel harassed by her everyday. I do pay the current rent it is just that i have no money to start making payments on anything else I pay all the bills and everything, and there is just never any extra money. What can I do? I just don't know what to tell her amymore?

Tenant failed to pay security

If a family is living in a house and is

behind on rent am I obligated to do

any repairs. They have never paid

the required security that was due

upon move-in. I trusted them to do

so but they moved in when I was

away. I told them they have to leave

and want to give a 30 day notice.

Now there are ''all sorts'' of things

wrong with the house, that I did not

know until I told them to move.

They also changed the locks and I

don't have a key. They are ready to

fight me.

I was severed a 30 day notice to terminate lease form but was ask to leave in 3 days while knowing the condo has been taking from him by the bank as of july 21 2008. Do I have the right to take him to court for making me pay rent knowing the place no longer is owned by him and do I have to leave? do I have the right to stay? can I take him to court? and can I sue him for my 3 months of rent taken from me?

Water Bill

I live in 2BR, 2B duplex. No kids, husband in Iraq. I received a water bill for $104.91 one month! Not too mention my electricity bill was $134.00. I gathered I am being billed for water usage for the water sprinkler system. The owner only has access to. Not in lease.Tried rectifying but they are not cooperating.

Apartment Rental Lease

Two years ago I broke my lease by one month and moved out of the apartment before the lease expired. I gave the rental office and the corporate office almost 60 day notice. The manager responded that she would not give me a waiver to end the lease a month early. I had lived in the apartment for 23 months and purchased a home which I got a great deal on. I could not afford to pay rent and morgage at the same month.The reason I decided to get a house and leave the apt was lack of safety and sanitary reasons at the complex. E.g. upstairs neighbor's toilet leaking into my apartment, several people staying in neighboring apartments but only one person on the lease and these people partying late into the nights, burglarly in an adjacent apartment, difficulty finding parking at night, etc. I verbally reported these to the office but I don't have them in writing. At one pint, I called the Police to break up a party in the neighbors apt upstairs.

I had a 3 yr old and was a single woman. The neighbors upstairs threathened me because I reporting their actions and they didn't like it. Last month I received an email from a collection agency that they will to garnish my wages if I don't pay the last month's rent.

Can I refuse to pay?

The Sheriffs office served my tenant with an eviction last Friday. They have 5 days. It appears that they have abondoned the place as it is filthy with rotting food in the kitchen etc. Since it is a hazard can I start cleaning before I get a writ of possesion. it is becoming an enviromental hazard

I bought a house put roommate on the deed to get her insurance on the house. Now I WANT to get her off the deed. What form do i need to do that?

My daughter has a live in boyfriend who won't leave though she has repeatedly asked him to do so. He is a paraplegic so I assume the laws may differ. The apartment is in her name. break apartment lease because leaving the country

is it possible to break a lease contract for an apartment because i am leaving the country? i am in california for one semester as an exchange student and life in an apartment with a 10 month lease which i will only need 5 months of. if i dont find another person to take over the lease can i cancel the lease contract because i am leaving the country and will not come back?

No sec deposit..no lease?

I had a tenant sign a standard one year lease on the 19th of sept. They gave me a personal check for the security deposit. The least starts Oct 1st. Prior to that I got the check back for insufficient funds. Is the lease still valid?

Landlord issue.

Firstly I would like to thank you all for the answers to my previous questions. Being that I have just moved here from Ireland, I am not familiar with the US Legal system.

Last week, my landlord came about our cat. Even though her letting agent said we could have a cat, which I had forgotten about but we had a cop, my cousin, was a witness to this, she states that we couldn't have a cat. I was so angry at her, that it ruined our camping weekend away with my wife's family.

I only added that as an idea to her past runs. Today about 11:30, I was in my kitchen and I heard the sound of cutting. I went to my living room and saw her looking in while pretending to cut the bust outside (I say pretend because when I went outside it was the same as when I saw it when I checked the mail!) I went back to the kitchen, and she came to the kitchen window and started complaining that I had the windows open in the apartment and that I'd ''Freeze the pipes''.

Sorry for the long winded question, but I think what I'm asking is, is this harassment or will there have to be more incidents?

I have also looked around and there are 12 HC Violations in the apartment, and I don't want to report them because I fear I'll have to see her more
