So, essentially, I will lose driving benefits for an entire year?
Breathelizer was high, but I have multiple G/I problems. During my 20 minute resting/observation period I was allowed to lie on my back. Between the acid re flux issues, bleeding ulcers, and Esophageal varices (https://www.mayoclinic.org/diseases-conditions/esophageal-varices/symptoms-causes/syc-20351538) there are plenty of reasons why the breathalyzer result would be skewed. I requested a blood pull, but was told that I had given that right away.
Please tell me I can still drive with restrictions? Thanks for any advice. Maybe I need to bring in an expert and make this a trial?
Was this a first time above a .15 or below? A first time DUI consists of a 6-12 month license suspension. If you otherwise qualify, you should be eligible for a hardship license for the majority of the suspension period. Speak with your lawyer for more information.
Good luck,
If you have taken the breath test, you will lose your license for 6 months if it is s first offense. However, you are eligible for a business purpose only license once you sign up for DUI level one. If this is a second offense, you may wish to consult with the bureau of administrative review to determine eligibility. DUIs from other states may factor into license eligibility.
