Hello I am fighting a DUI case as we speak and I know that I will win the case because I wasn't driving....but when it comes to getting my licence back will I still have to take DUI classes and pay for my licence to get reinstated when Im not guilty?

Hopefully you have an attorney because you don't have to be driving to be convicted of a DUI and if you act as your own attorney you will certainly lose a jury trial.

As for the DMV, you need to request a hearing, generally within 7 days, in order to avoid a suspension. This process is separate from the court case. Prevailing in the criminal court does not automatically change what the DMV has done.

You should discuss this with your attorney.
