Hello, The federal regulations do allow a cancelation of any visitor's visa upon a conviction or even an arrest for any offense. Therefore, legally, her status can be affected even if she never goes to court. Unfortunately, I am not certain about the odds of that happening. Sorry.

is your question what are the odds of her going to jail then that might depend on the court, the DA and the Judge.
in the riversides court in Indio almost all DUI have the DA asking for jail time.
however none of my clients go to jail. we work out an alternative to jail.
Family Law - Visitation of NCP
I took guardianship of my grandson, with my daughter's consent, in Nov 2005. In January 2006, the Superior Court ordered supervised visitation for the NCP through a supervised visitation center. Now, the NCP filed in Probate Court for unsupervised visitation and a GAL was appointed. The GAL report is extremely biased in support of the NCP having 8 hrs unsupervised visitation and overnight visits at once. The GAL's report states that I have some significant and severe medical disabilities that such as I am unable to drive and has other limitations and is concerned that my health problems might interfere with my ability to care for the child on a long-term basis. I have diabetes, have never been determined to be disabled, do not receive SSI, do not have a handicapped tag issued to me for my use. How do I go about getting this GAL impeached and removed from the case? There are other issues with the paperwork from the GAL such as the incorrect names on the cover letter at the beginning.
Slow Moving Executor
I was wondering how do I get the executor to my mothers will to keep me updated. The executor is my brother. I do and have not spoke to my siblings in close to 3 years. I requested in writing, months ago, that I be kept updated on a reasonable basis. I received a ''You're an a-hole & a how dare you we are still morning letter '' at my work address from my sister. Not one word from the executor. He is not paying the property taxes on land my Mother willed to me. I have paid the last 4 quarters. Two from last year to avoid the tax sale of the land and 2 from this year. I sent him copies of the paid tax reciepts with the letter requesting to be updated. If he is not paying these taxes what else is he not doing? I have not a clue as to where he is at or what is going on. My mother died 8/27/06 and the will was probated 9/06. The will is pretty basic. All monetary things to be divided among her 6 children. Certain things left to this one or that one but pretty straight forward. Truthfully I don't know what to think. I do know requesting anything is writing is pretty much useless. Where do I go from here? (I am not sure who or if there is a lawyer for the will. I just know the name of the lawyer who drew it up) Thanx

My stepmother wants to put my father in a nursing home because she feels she can't take care of him. Can I contest that decision? He is welcome to live at my home and we are able to take care of him here. I don't believe my stepmother is making a decision that is in the best interest of my father. She just does not want any inconveniance put upon her. there is a 20 year difference in there ages. She has sucked every dime out of him and now she doesn't need him anymore. Do I have any rights to make any decisions?
