Under the speedy trial statute, a case needs to be brought to trial within two terms of court. There are disadvantage to filing a motion for speedy trial. For example, most courts will not entertain a plea agreement once you have filed a motion for speedy trial, which means you must have a trial in your case. Generally, you only file a speedy trial motion if you are in jail and cannot get a bond, you do not want any plea offers, and want to have a trial as soon as possible.
I sent a lease that I had signed, as I am the landlord, to a prospective tenant. I asked prospective tenant to sign the lease and return it with a deposit check. I have not received signed lease or deposit and now want to ask a real estate agent to find a tenant.
I am concerned that I signed the lease. Does this cause any problems for me going forward? Should I tell the prospective client that given there has been no commitment on their part the contract is null and void? Thanks Carol
I was involved in an auto accident, with an 18 wheeler totaling my car with my fianc� and two children inside the vehicle. The accident occurred oct 25th and physical injuries resulting from the accident were limited to neck strain for myself and my fianc�. I have been in physical therapy to this day recovering from whiplash and my fianc� has been out of work suffering from PTSD, something she was diagnosed with before the accident and was triggered from the accident. She has just recently lost her job thanks to being out of work even though it was approved leave from both her doctor and psychologist.
At this point I spoke with an attorney as the medical bills and physical pain has taken its toll. We live out of state and are unfamiliar with New Jersey law, or even how the specifics of a no fault state like New Jersey will affect our claim. According to the attorney, we may not be able to sue the truck driver who merged into us, which the police report proves was his fault, for anything unless we were maimed, dismembered, disfigured, or lost a fetus.
Being unfamiliar with New Jersey law, I find this a little rediculous that I am unable to sue the truck driver for pain and suffering, especially with my fianc� suffering from PTSD and losing her job as a result of the accident.
Any information regarding our options or personal experiences relating to ours would be greatly appreciated.

Cell phone contract
I was under the impression my Sprint cell phone contract had been terminated. It wasn't, my mother had put my phone on military hold. Well, it was ''on hold'' for approximately 2 years, meanwhile I thought the phone had been disconnected. During this time I got married (changed my name). I called Sprint to inquire about a bill I received since I thought the contract had been terminated. The woman said, your contract ran out so you don't have to pay an early termination fee, but you DO need to pay the last 2 months service charges (61.00)... even though I never used the phone. Is this contract still valid? The name on the bill is my name before I got married.
