Plan on filing Monday. He is on me too pay past due rent. I cannot pay past rent and still pay my current bills at the same time. The last we talked in the driveway, he was very disrespectful and rude. Several cuss words, and trying to intimidate. In other words, if it happens again I'll most likely be in jail. So I just want him to stay away until i have a plan for fixing my financial problems. I feel once I tell him, he will back off. He is so disrespectful that I wouldn't be able to calm myself if he happens to come by and only my girlfriend is home, because he has made it a point to let us know he thinks women are beneath him and are told what to do. Sorry for the novel.
Should I tell my landlord or just call the police when he comes by with his threatening attitude ? And we are both on the lease, and several credit cards and debit card, do we have both file or can I just file, how does that work ?
If you owe something to your landlord, you definitely have to list him as a creditor when you file for bankruptcy protection.
You also ask "should we both file [?]". It is possible for you and your spouse to file for bankruptcy protection jointly.
