Last month I have signed the final divorce agreement that I 'll give him the house, and all the documents are signed including the release of deed to him, and till now nothing have been done to final our divorce at the courthouse accept he had already file to the county for the change of ownership of the house. I've seen this referred to as wholesaling or assigning contract. Numerous real estate professionals advocate this technique of making an offer on a contract and putting down the buyer's name ''and/or assigns.'' The person making the offer puts the property under contract to control the property, then sells the rights to that contract to another assigned party. In this case, the person who originally put in the contract is able to profit and never will have to close. I have a friend who is insisting this is illegal, but I've seen this advocated by every investor under the sun. Is my friend correct??
My Parent's landlord has moved back to the state and wants the house back. They haven't violated the lease agreement in anyway and have always paid on time by check through their bill pay. Now they want to stop by on the day the rent is due every month and pick it up. This makes it difficult for my parents to keep records of the transactions and I'm afraid the landlord is going to try to make it look like my parents refused to pay by not cashing the check because she wants out of the 4 yr. lease she agreed to. Is there anything my parents can do to protect themselves from this devious woman?
