How can a contractor cancel a contract with a customer?

I am a subcontractor in Fl, I completed a job for a builder who is now refusing to pay me--I filed

the n.t.o. and lien in the alloted time, can i now start for foreclosure proceedings on the house that I liened?

Failed to do change order!

written. when job was finished they did

Lien on property to recover construction debt.

We hired a contractor to put a second story on our house. The contractor hired a crane to lift the trusses and put them in place. Apparently the contractor was not financially sound (which we found out later) and did not pay the Crane Company. Now the Crane Company sent this to a collection agency and wants us to pay, threatening to put a lien on our house. The contract does not stipulate anything about a crane and we feel that the Contractor should pay since he hired the Crane. We tried to stay one step ahead of our contractor money wise and we feel he was fully compensated for the work he did at the time my husband fired him (poor workmanship and failure to meet deadlines). We fall under the 15% rule but is there a deadline for filing a lien? This work was done over 2.5 years ago.

Contract/ Permiting

I had an alarm installed in my house a little over a year ago. It never worked right, the permit ran out and now the city is leaning my property because of fines from an exipred permit. The contractor obtained the permit and he has to close/renew it. Why am I responsible for this permit when I never obtained it and I cannot renew or close it? Seemes to me that the alarm contractor should be fined not me.

surety bonds

if you get complaints on the bond but not one is exacuted and most are droped by the people that isued them can the bond drop you for high risk,even if the bond never payed out any money??

faulty product

Contractor purchased exterior staining product for log home. Instructed employee to apply stain to logs. Stain was applied. Contractor discovered from rep. who sold him stain product that logs were to be sanded before stain application. Stain has to be sandblasted/removed. Who is responsible for this cost, contractor or employee?

Remodel/air quality

I hired a licensed contractor to do a remodel. He is now asking for his final payment and informed me he had an Industrial Hygienist sample the air 4 weeks ago (unbeknownst to me) and will let me know the results when he gets them. The contractor states he and his 2 workers have been having respiratory problems and sores in their nostrils. This home had severe odor from a dog prior to the remodel. Is he in any position to file a lawsuit if the air quality is hazardous?

My crew made gutter on site but did not install, and sold additional materials to another contractor ti install on our local McDonald's. There was no written contract. He did not pay. I cannot reach him, and word is he went under. Can I file a construction lien on the property where the items were installed?

The bill is only $275.00 so can't justify lots of legal fees to collect.

If yes how and where do I file this lien. Is it good until I get paid or does it become invalid at some point?

Is there any laws that prohibit--name removed--general contractor from disclosing details (either orally or the actual hardcopy signed paper contract) to nosy inquiring neighbors?

Our GC who left us high & dry & unfinished...ironically is on--name removed--jobsite for our neighbors. We think it is possible they made him an offer for more money & knew our contract wasn't very well written....bought him off our job to work for them.

Isn't this illegal...if not it should be!

Home warranty & Contract

We are 9 months into our new construction home and have several issues, we are still waiting for our land to be graded and hydroseeded, we have a punch list 4 pages long as well. In general the builder will respond to our letters but never follows through. We have hardwood floors that are cupped and need refinishing, we feel he should pay to have everything moved out when they are refinished, he wants to move stuff onto our (unfinished) deck and cover it with tarps! Also we have on our spec sheet (initialled by both parties) 2 things that were never done, can we force him to install these items? We also need to know if we can place a lien on some of the other properties he has for sale until he completes the work on our houe? We feel he is going to band aid our problems (we have exterior drainage issues) and we will be out of luck next year when we are out of warranty.....HELP!!

Job Payment

Completed store front garment store,final payment of 4,700 due,4,000 retainage due 30 days.New Certificate of occupancy issued 5-11-07. 2,000 paid 5-11-07 and refuses to pay 2,700 balance, payment of retainage does not look good at this point.I have written contract, lots of doucumentation on upgrades and additional work.
