How do you file a power of attorney? Can more than one person hold POA over the same individual? This is in reference to an elderly relative with failing eye sight that can no longer handle bills, pension plans, banking... etc.

I hired a licensed contractor to do some remodeling. We have a contract that states any additional work must be placed in writing and signed by both parties before work will be done. He then took it upon himself to do additional work without getting it in writing and charged an excessive amount, he did this towards the end of the project and now he wants his final payment. Can he place a lien against my property?

unfinished work

I'm a licensed contractor who did the cabinets and finish carpentry on a remodel. The GC refuses to pay me the balance due claming the job was unfinished and that he had to pay some one to complete. I Know that I completed the job and was told so by the GC before he came up with this excuse not to pay me. Can I put a claim in against his bond?

disaster issue.

i hired a contractor to tear down a building which contained asbestos in it. the contractor tore it down 85% without checking for asbestos- the contractor was stopped from disposing by the epa, also he also recieved permit from the city and i am unsure if he recieved one from the epa. my question is- i was the owner of the property I did not have any knowledge about the asbestos, although i believe as a contractor, a contractor should be aware of asbestos terms and regulations am i correct?

mechanic's lien from subcontractor

I am a licensed general contractor who did some work remodeling a house. I haven't been paid for the final week of work, even though I provided a bill ( and the amount was consistent with previous week's work, for which I got paid). I recently received a check for less than 1/3 the amount owed along with an itemized list of items deducted from what I was owed. These were mostly ''supplies'' and there was no agreement that I supply my own materials, etc. I haven't cashed the check. Is filing a mechanic's lien appropriate, or do I first need to go to small claims court?

contractor with a suspended license

March 2, 2007 we signed a contract with a man to have work done on our home. His deadline was April 2, 2007. After signing the contract and giving him $19,000 we found out his license had been suspended, we had him and the capenter sign another agreement that the work would be done to all above specification. The carpenter later walked out on the job after having an argument with the contract. We are a month behind the agreement date. Are we legally obligated to pay him the full amount due? Can we penalize him for not being done on time? Some days no one shows up for work and we are feed up. HELP!

What is the statute of limitations on a faulty home inspection

I bought my home in 2003. At the time of purchase the home had 3 layers of shingles on the roof. It has now come to light that there was significant rot to the underlying plywood and the entire roof has to be replaced. Can I pursue damages from either the home inspector who didn't address this code violation or the previous homeowners who failed to disclose this on the state required disclosure form? The repairs will excede $10,000.

Poor quality

We are having a porch built. The concrete contractor is on the 8th week of a one week job. The work that he has done to this point is terrible. The concrete has several large cracks in it and they just poured it two weeks ago. It also is extremely uneven and discollored. The stuco also has cracks in it. We have already paid this guy half of what the job costs and it will take more than that to fix the errors. What are our options at this point?

Unlicensed contractor refuses to finish 2nd story addition

My father made the mistake of hiring an unlicensed contractor to add a second story to our house. They agreed on $68000 plus materials. He was to deliver the house finished, having passed final inspection. Nothing was written down, though my dad kept records of each payment.

Here we are six months and $62k later and the house is still not finished. He does not send his workers when he says he will and does not return phone calls. We will attempt to resolve this directly with him but do we have a legal recourse to fall back on? What would be the most prudent course of action?

I rec'd a subpeona with a less then 48 hr notice to appear as a witness. What is the legal time frame a witness is to be notified to appear??

I live in Montana and my home was built Dec. 05 and on April 12th 2007 I now have some leaking into my basement and the contractor told me that it wasn't his problm that I shouls call my insurance co. I was told that there is a law called the warranty of habitant. Please explain this to me and tell me how I can get more information on it.

Construction Fraud Charges for Co Officer of Corp

We sent a client a breach letter and she responded by obtaining a warrant for our co president for construction fraud - the one check she wrote was made payable to the corp and we have receipts for materials, time sheets for employees at her job site and sub contractor invoices, becuase she never made any progress payments or final payments we are at a loss - how can she get a criminal warrant for a co officer? He is not even the designated employee for the contactors license

If my bid was less than half of the other bidders, is it the responsibility of the General Contractor to notify me to check the list of items bid on, to make sure nothing was missed in my bid?

Floors

Hi my name is--name removed--I built a new house and sold it in Sept 2005. Had a problem with the floors had some gaps. Homeowner brought it to my attetion about 3 months after moving in. Tried to repair by resanding and filling the gaps. Did not work about 3 months later gaps appeared again. Homeowner now wants a complete new floor. I will provide him with a new floor do i have to provide him with relocation expences storage etc. The job will take one week to remove old floor and install new floor will have to leave sit for about two weeks before sanding and finish. I can store his furniture in his garage . He could stay in the house while we remove and install the floor (maybe he will not ) but woul have to move out for sanding and finishing for about one week. Please advise me Thank you--name removed-- I live in California.

Matress

I live in a 6 family building. Saturday I took an old matress outside on the sidewalk fot sanitation to pick it up. During the night the matress caught fire, propably somebody through a cigarette, and did some damage at the front of the building. Nobody got hurt. The fire department was called and put out the fire. Am I personally liable for the damage on the building?

Default Judgment

Now that I have a judgment how do I get my money. We have sent two letters with no answers.

CALTRANS not paying contract

CALTRANS gutted my contract by 30% then had me put in 100% more in changes. Won't pay changes and won't pay contract. Can't get GC to move on anything. Anybody have any help?
