If a CD or savings account has three names on listed (mother, son and daughter), can a nursing home take the whole account?

We have a CD with an elderly mother and two adult children listed on it. We are now afraid that if she was to go to a nursing home, we will lose the whole CD. Is this true?

What are the benefits of a power of attorney? She is 83 years old and no power of attorney. We do not know if it is needed or not.

my grandparents live in NJ and should not be living alone. I am in a different state and cannot move to NJ to take care of them. They are unwilling to go to a home or give power of attorney what options do I have?

How does my Mom regain control of her funds and assets, if her former POA refuses to return them to her?

So far, her oldest son, the soon-to-be EX-Power of Attorney, totally denies my Mom any access to her checking accounts and assets. How does she reclaim what is rightfully hers?

Have already asked my brother (POA) to return all checking accounts and financial information to my Mom, but he still does not comply.

We are in the state of Georgia. My mother-in-law was admitted to a nursing home on 9/17/12. The family is divided over how to handle her estate. While we were all still in discussion mode, my sister-in-law forged her mother�s signature on a Power of Attorney grant and had her cousin, who is a notary public, notarize the document with a false date (a date that occurred prior to her admittance to the nursing home). We are not interested in taking anyone to court � we just want to protect her assets where they can be used to pay for her care. What steps can we take, legally, to:

� Remove the power of attorney from this particular sister-in-law.

� Give the power of attorney to a different sister-in-law.

� Freeze the account (except for bills) while all of this is taking place.

� Ensure all decisions that affect her estate are made as a family - with a majority ruling.

� Ensure her estate remain intact until it is no longer of use to her.

Can my sister sell my mother's home without the consent of her 4 other siblings?

My mother has dementia, and has not lived in her house in about a year. Myself along with 2 of my sisters take her to our homes each week. My brothers and I went to the house and saw pictures removed, empty closets and a cleaning crew there. We believe she had my 86 year old mother with dementia sign something with a realtor and never consulted us about it. Is there anything we could do to prevent the home from being sold?

In florida, my father has a house that is paid off with both his name and soon to be ex wife name on deed. It has the denotation ...something in entirety..not sure, but the jist of it is if he dies, she gets the house. The question is - can he request t change this denotation on the deed, so she won't out wait him and stall the divorce so she will get the house?

Can he ask the judge to change this wording? How to proceed?

I am a 74 yr old lady married to a 76 yr old man who has been taken by the doctors office,Sheriff's office and the coroner's office to a Mental or Behavior center for his actions.One action was to pull a loaded pistol on 3 carloads of deputies.They took him to a mental facility instead of jail.He has verbally and emotionally abused me,Threatened me with physical harm but yet each place he has been evaluated says"we can't find anything wrong with him".He says he can't "remember things" and refuses to take any meds.I have no place to go and he refuses to leave.I don't drive anymore because of a massive heart attack plus very bad arthritis in my joints.He abandoned me in April with NO funds for me and in 2 months he showed back up and started screaming at me "to get out"because "this is community property".He has been confined in 6 facilities for his actions but its always the same answer.Nothing wrong with him.I am so stressed out and scared of him that I've had chest pains.The battered womens program(I put him under a restraining order)and the judge did not see any of us ladies but I did get a bill from Iberville Clerk of Court for 180.00 but for what?My finances will not permit me to get a place of my own .My income is 686.00 S.S. and his is 1274.00 but he says thats his money.Please help me.Someone (?) called Elderly protection Agency and she came out here and talked to me and my 52 yr old disabled son(has pacemaker and defibulater(4 heart attacks)plus she said she had talked to the sheriff"s office(one deputy had responded to my calls for help 3 times himself)and he said she had never called their office as it would have been documented.She called me and told me I was lying about my husband.He has been in 2 mental facilities since she came out here.Her name is Ms.Jackson in Baton Rouge.My son lives next door.My husband needs to be in a nursing home because he refuses to take his meds,does not bathe and if I fix him a plant and sat it before him,he will eat but otherwise he won't.I am so tired and heart-sick.Thanks for listening to me.
