if my father is getting older and we are going to sell his house to pay for assisted living care. Can items such as an old car be given to a brother.

Car is only worth about $1000. My other brother is concerned that would be considered a gift and irs issues or if later when his money is gone before he dies that if he needs medaid asst. that might cause probs too.

we are also trying to get help from VA but they are slow. Brother is also worried about keeping some money from sale of father's house for burying him if VA doesn't come thru in time. said could take years to find his records.

We believe our elderly uncle is being taken advantage of by his housekeeper and one of his friends. He is 86 and lives alone, and we believe these people are conspiriing to empty his bank accounts. They have admitted using his charge cards to make purchases, his ATM card to make withdraws, and had him transfer title to his automobile. Recently, our uncle received a $250,000 payout, and now he has no idea where the money is.

We know something needs to be done, most likely some sort of guardianship. But are we too late? Please advise!

This going to be a long letter. I need to start from the begining so you get the full meaning of this. My mom got my daughter at the age of 3. My daughter is 37 now with a daughter of her own. I just found out on mothers day of some very bad things that has happened over the period of the last 2 years. My mom is 93 years old and lives by her self. Mom has raised her like she is her own daughter. Mom was inthe hospitol having surgery done and my daughter went to her house and took the money mom had hid in the deep freezer and in the table drawer. She then went to the bank and took all of her money totaling over $20000 and mom has not seen her again in 2 years or no where she lives.

That left her with no money and checks started to bounce. My mom has been paying my daughter's rent, eletric bill and buying her food. My daughter thinks she is to good to live in Pekin so she lives in Morton in some apartments that costs mom $1000 a month rent, electric, food and water. She also got tricked into buying her a $32,000 pickup truck.My daughter has a job but we cant figure out where her money goes. I told mom i think she is on meth. The last time i seen her she shows all the signs of a drug user.

Mom doesnt want to have her arrested because she is afraid of what will happen to kaylee(the grandaughter). I live in Arkansas and i am not able to be there to take care of mom.

My question is can she be arrested for her crimes with out mom filing charges. I know for sure my mom wont sign or tell anyone what is going on. Is it also possible to get a restraining order against her? It broke my heart to see my mom sitting there pennyless, why this piece of trash is living high on the hog. I think elderly abuse should also rank up there on charges as well of theft even though her name was on account. Mom's neighboors have been a God send. One of the neighboors has power of attourney and gives mom a allowance for the week. Is there any thing we can do to have my daughter arrested without mom's knowledge. I am sure the neighboors would be willing to tell you what has happened and this sweet woman has been manipulated into this. All of my daughters life mom has given her everything she wanted, this is the problem with her. Can the police pick her up without moms consent for theft and elderly abuse. I truely beleive will slip in mom's home some night and kill her just to get the house. My mom has been minipulated and brain washed so long by my daughter she just cant accept the fact my daughter is no good.

Please help me out, i am at the end of my rope trying to figure out what to do without hurting my mom and still see my daughter prosecuted.

I have a dear friend who is very ill. He has been in a rest home and was rushed to the hospital today. I am his Advanced Directory, however he has asked me to be Power of Attorney. He has no family, no home and no money........but is does have a car, a storage unit and a checking account. If he should pass what would happened to his items. I have been told that a Power of Attorney is only good while the person is still living. Is this true? I would like to be able to donate his assets or use some for his funeral when the time comes.

Also, am I resonpsonable for any of his debts.

My friend lost her husband in January and her intended lost his wife six months ago. She is anxious to marry him. She will move into his home. He does not want her to bring very much of her stuff into the house. He wants her to merge her finances with his. She received her husband's life insurance, his pension and social security. He wants her to sell her 18 acres of land. She is 73 and he is 80. How should she handle her finances and keep from being taken advantage of?

I was appointed Conservator of Person of my mother 7 years ago. My Mom is now in a memory care unit for Alzheimer's and doing okay. My sister hasn't seen our Mom these past 6 years and never questioned my Mom's care until recently. Now she is requesting doctor's notes and test results from every visit and requesting I take her to USC to be checked out. My mom has seen her family doctor for 30 years and her Geriatric Psychiatrist for 7 years. She has also seen her Neurologist for several years and visits each of them every 3 months. They all agree she is in good hands and receiving the best care possible. They are all highly respected doctors in the county. I have been sending her a general write-up of our Mom's visit such as BP, Meds and overall health.

While I have shared some test results with my sister I have learned she is sharing them with other doctors and seeking their opinion. She then questions the care Mom is receiving from her current doctors. She has retained an attorney and is threatening legal matters if I don't give her the doctor's report and test results in full. She is also threatening to have me removed as Conservator.

What rights do I have to protect my Mom's private information and is my sister entitled to reports and test results? My sister had a very troubled past including bringing felons into our house. She stressed our Mom out to no end and maybe now feels she is coming to the rescue. I don't know what to do so need some guidance. Thank you.
