Findings Of Fact During January, February, and early March, 1982, Respondent entered into several oral contracts for the purchase of tomatoes from Petitioner. Specifically, orders were placed by Respondent on January 28, February 3 and 5, and March 3, 1982, for US. No.3 grade tomatoes to be shipped f.o.b. origin to receivers in Puerto Rico and Alabama. The first three orders were shipped by boat to Puerto Rico and the fourth by truck to Alabama. The shipment of January 28, 1982 (Shipment #1), consisted of 1,296 boxes, and the invoice cost was 9,288.90. Payment was due on or before February 17, 1982, per the handwritten note placed on the invoice by Ms. Ernst before it was mailed out. A similar notice as to payment due date was placed on each of the other invoices before they were mailed out. The shipment of February 3, 1982 (Shipment #2), consisted of 1,368 boxes; the invoice cost was $9,188.10; and "payment was due on or before February 22, 1982. The shipment of February 5, 1982 (Shipment #3), also consisted of 1,368 boxes; was priced at $9,188.10; and payment was due on or before February 24, 1982. The shipment to Alabama of March 3, 1982 (Shipment #4), consisted of 1,178 boxes; the invoice cost was $7,748.70; and payment was due on or before March 23, 1982. Shipment #1 was inspected by a United States Department of Agriculture (USDA) inspector in the receiver's cool room in Puerto Rico on February 5, 1982, eight days after it was shipped. At that time, the inspector noted that the condition of the tomatoes was "approximately 40 percent green and breakers, 45 percent turning pink, 10 percent light red and red. Decay ranges from 2 to 6 percent, average 3 percent, Bacterial soft rot in early stages." The grade was noted: "Fails to grade US. No. 3, account of grade defects." Quality was noted as: "Mature fairly clean to clean, well developed, generally fairly smooth to slightly rough. Grade defects ranges 40 to 56 percent, average 47 percent, mostly scars, catfaces, cuts and rough texture." Shipment #2 was inspected by a USDA inspector in the receiver's cool room on February 16, 1982, 13 days after shipment. At that time, the inspector noted as to condition: "Average approximately 95 percent red. From 2 to 8 percent, average 4 percent decay; Bacterial soft rot and Gray Mold rot in various stages." Quality was listed as: . . . grade defects ranges 12 to 28 percent, average 19 percent, mostly growth [sic] crack, catfaces, cuts and scars. Grade was noted: "Fails to grade US. No. 3 account of grade defects." Shipment #3 was inspected by a USDA inspector in the receiver's cool room on February 17, 1982, 12 days after shipment. On the inspection report, condition was noted: "Average approximately 85 percent red. Decay ranges 5 to 24 percent, average 14 percent. Gray Mold rot and Bacterial soft rot in various stages." Quality was listed as: . . . From 12 to 32 percent, average 18 percent grade defects, mostly scars, catfaces, mechanical damage and rough texture." Grade was listed as: "Fails to grade US. No. 3 account of grade defects." Shipment #4 was inspected by a USDA inspector in the receiver's warehouse in Alabama on March 5, 1982, two days after shipment. Upon inspection, condition was noted as: "Strano's Pride lot: Average approximately 30 percent green, 5 percent breakers, 20 percent turning, 20 percent pink, 15 percent light red, 10 percent red." As to Select Lot: "Average approximately 20 percent green, 20 percent breakers, 15 percent turning, 20 percent pink, 10 percent light red, and 15 percent red." Each lot was average 1 percent decay. Grade was not quoted, nor was quality. Ordinary shipping time by ship from the Port of Miami to Puerto Rico is four to five days. Inspections under the USDA Perishable Agricultural Commodities Act rules must be conducted within 24 hours after delivery. The USDA inspector is generally accepted as the only nonpartisan means of determining grade, condition, and quality of produce. While the condition of a shipment may change during transit, the grade of the produce normally will not. When the delivery inspections on Shipments #1, #2, and #3 were conducted in Puerto Rico and the receivers complained to Respondent about the produce they received, Elliott, who had been in daily telephone contact with his dissatisfied customers and had verified the condition of the shipments in conversations with the inspectors in question, contacted Tom Banks, Sales Manager for Petitioner, who authorized adjustments in payment saying, "Work it out and get back what you can, or words to that effect. Discussion between these two men as to the adjustments included such topics as charges for gassing and freight to the gashouse, along with the fact that the tomatoes failed to grade out at destination as US. No. 3, as ordered. Mr. Banks failed to get the approval of Mr. Strano before authorizing those adjustments, however Respondent had ordered green tomatoes without gassing so that there would be less chance of spoilage during the several days it took in transit for the tomatoes to get from Miami to Puerto Rico. Gassing, a procedure designed to speed up the ripening of tomatoes, would not have been an appropriate process in a situation such as this. With regard to Shipment #4, Respondent wanted vine-ripened tomatoes for quick delivery to a close-by market. He described his order as for 40 to 50 percent color in the shipment. The tomatoes delivered contained color well below the desired level; and as a result, the Respondent's customer, who had to hold them for an extended period before sale to allow them time to ripen, was dissatisfied with the shipment. The tomatoes in Shipments #1, #2, and #3 were graded as US. No. 3 by a USDA inspector at Petitioner's plant outside Miami prior to shipment. The procedure followed is for the inspector to inspect batch lots containing amounts far greater than that in any one of the shipments in question here. The inspector puts his stamp of grade on a master inspection certificate. Thereafter, whenever any tomatoes are drawn from that batch for sale and shipment, the Petitioner's employees are authorized to mark the appropriate grade for that shipment onto the documentation relating to it. There is no additional inspection by the USDA at origin. However, Petitioner could provide a document trail for only two shipments. One, of 1,368 boxes to Puerto Rico on February 3, 1982, was Shipment #2. Certificate No. B 135642, referring to Gas Lot 306, reflecting a grading of US. No. 3 on February 2, 1982, can be traced to that shipment. Certificate No. B 135588, which was offered in support of Shipment #3, on February 5, 1982, affords reasonable connection to that shipment. There is no documentation, other than Petitioner's own shipping memorandum, which relates to the preshipment grading of the tomatoes in Shipment #1. No credible evidence was introduced to establish the grade of produce in this shipment which failed to grade out as US. No. 3 upon delivery. I therefore find that the grade assigned by the inspector at the delivery point is controlling and that the shipment of 1,296 boxes on January 28, 1982, was not US. Grade No. 3. Respondent deducted $3.25 per box on Shipment #1 ($4,212), $1.50 per box on Shipment #2 ($2,050), $2.50 per box on Shipment #3 ($3,420), and $2 per box on Shipment #4 ($2,356), plus $752.40 each on Shipments #2 and #3 for gassing and freight to the gashouse.
Recommendation Based on the foregoing, it is hereby RECOMMENDED: That the Department of Agriculture and Consumer Services enter an order finding that Respondent is indebted to Petitioner in the amount of $5,470. The Issue Whether or not an Administrative fine may be imposed upon proof of allegations contained in the Administrative Complaint dated June 6, 1986, wherein Respondent is charged with violations of Section 482.226(1), (2)(f) and (g), and 482.161(1)(a),(e) and/or (f) Florida Statutes. Petitioner presented the oral testimony of Roger Gagnon and Frederick Hassut, Jr., and had 3 exhibits admitted in evidence (P-1, P-2, and P-4). Respondent presented her own oral testimony and that of Susan Rickenbach and had admitted 1 exhibit (R-1). At the close of Petitioner's case in chief, and at the conclusion of her own case. Respondent moved to dismiss for failure to prove the allegations of the Administrative Complaint. Ruling on same was reserved for disposition in this recommended order. No transcript was filed. Both parties have filed post-hearing proposals. To the extent they contain proposed findings of fact, these proposals are ruled on pursuant to Section 120.59(2), F.S., in the appendix hereto. Respondent's post-hearing Motion for Dismissal is ruled on in the course of this recommended order.
Findings Of Fact On October 16, 1985, Diane M. Jellen, representing Terminix International, Inc., Cocoa, inspected the property consisting of 12 units which is located at 141 Bluff Terrace, Melbourne, Florida. The inspection was for purposes connected with a real estate transfer. Ms. Jellen issued a report of findings on a Wood-Destroying Organisms Inspection Report (HRS Form 1145, May 1983) dated October 16, 1985. At the time of making the inspection, Ms. Jellen felt herself to be sexually harassed by an individual representing the seller who obstructed her entry into certain units, and she did not complete the inspection of each and every unit for this reason. The top portion of the report issued by Ms. Jellen indicates that Ms. Jellen is the "inspector" and states: "Specific structures inspected: 12 units; Structures on property NOT inspected: none; Areas of structures NOT inspected: none." Essentially the report goes on to indicate that no wood destroying organisms existed. However, at the bottom on the COMMENTS line, Respondent wrote "not all apts accessable" and "low crawl." She made the latter comments in reliance on instructions from her Terminex supervisor that this was sufficient. 1/ Thereafter, partly in reliance on Ms. Jellan's report, Mr. Roger Gagnon purchased the 12 units previously inspected. On May 14, 1986 Mr. Roger Gagnon, owner of the property, filed a written complaint alleging that the inspection performed by Ms. Jellen on October 16, 1985, had failed to detect evidence of wood destroying organisms which were present within the structure at the time of the October 16, 1985 inspection, and which wood destroying organisms Mr. Gagnon had subsequently discovered. On May 15, 1986 Frederick Hassut, Jr., Entomologist-Inspector for the State of Florida Department of Health and Rehabilitative Services performed a wood-destroying organism inspection of the premises which revealed wood-decaying fungus damage present in wood braces and overhang located above apartments No. 3. and No. 4; in several wood members of the stairway and railing adjacent to apartments No. 3 and No. 4; in several floor joists located within the storage room of building No. 2; in the baseboard located in the bathroom of apartment No. 10; and in several wood members of the stairway adjacent to apartment No. Further, he found drywood termite fecal pellets and damage in the east window frame located in the living room of apartment No. 3. Mr. Hassut determined, within his expert education, training and experience, that the old wood decay, fungus damage and the dry-wood termite evidence and damage had to have been present and visible on October 16, 1985, when Ms. Jellen issued the inspection report indicating an infestation. Terminex International subsequently repaired all losses incurred by Roger Gagnon at its own expense. Prior to the time of the inspection, October 16, 1985, Respondent had filed an application to become a pest control employee identification cardholder. Petitioner did not affirmatively show that the card was issued prior to the October 16, 1985 inspection, however Ms. Jellan's application, admitted in evidence as P-4, specifies the agency policy that: "The effective date of this ID Card when issued will be the date of receipt of post- mark if mailed, of this application." The application bears two receipt dates: "10-3-85" and "October 07, 1985," both of which pre-date the inspection at issue. The parties agree that an identification card was subsequently issued. Accordingly, Respondent is found to have been an identification cardholder as contemplated by Chapter 482 F.S. 2/ and therefore subject to Petitioner's jurisdiction at all times relevant. Respondent's unrebutted testimony that she was hired by Terminex International as an office salesperson and was insufficiently trained by that employer to do wood-destroying organism inspections is accepted but deemed irrelevant and immaterial. In mitigation, it is noted that Respondent has, at her own initiative, recently completed 5 days training in pest control with an eye to continued competent employment in this field.
Recommendation That DHRS issue a final order of private reprimand to Respondent for negligent performance of a pest control inspection. Findings Of Fact Respondent is licensed by the State of Florida, Department of Health and Rehabilitative Service as a pest control service authorized to perform all functions for which such organizations may be licensed. Gilbert Bellino was certified operator for Respondent from prior to the earliest charge in the Administrative Complaint until mid-1977. He was certified in the four types of treatment authorized by pest control companies, viz. fumigation, general household pest control, including rodent control, termite or other wood infesting organisms control, and lawn and ornamental pest control. A certified operator is required to supervise and direct the activities of all employees engaged in pest control. Many of the complaining witnesses made their first contact with Respondent when answering an advertisement for a onetime household pest treatment and a free termite inspection. Lloyd Green responded to an ad in which Respondent offered a spray treatment of the yard and house for $15. Folsom and Jones appeared and after an inspection of his house advised Green that he had dry wood and subterranean termites and induced him to sign a contract to treat them at a price of $286. After reflection and before any work was done Green called and cancelled the contract. He had the house inspected by Mr. Chapman of Chapman Pest Control who found no evidence of active infestation. All evidence Chapman found of wood damage was done prior to the timber having been processed. The house was later inspected by David Jones, District V Entomologist and he too found no evidence of active infestation. A second inspection of Green's home was made by Jones in company with Casale, the President of Respondent. The only evidence found was one hole in a bed slat which had occurred before the lumber was processed. Turpentine beetles and pine sawyer beetles are wood borers that attack trees but not processed lumber. Once lumber is processed any further damage from these beetles is highly improbable if not impossible. Evidence of the damage they have caused will remain in the wood but is readily distinguishable from an active infestation by one with almost any training in pest control. Wood borers make round holes and any eliptical hole found in timber is indicative that the hole was made before the wood was processed. The oblique angle to the borer's tunnel cut by the saw when the lumber was processed causes an eliptical hole. Charles Casale visited Robert Rankin's house for a free termite inspection and identified himself as an employee of Respondent. He was accompanied by another man who inspected the crawl space under the house. Upon completion of the inspection Casale advised Rankin he had an infestation and needed treatment which would cost $300. After getting an opinion from another pest control company that he did not have termites Rankin called HRS and David Jones inspected the entire house. At this inspection Jones found no evidence of active infestation but a colony of fleas from Rankin's two dogs. At the time of Casale's inspection application for an identification card had not been submitted for Casale. Thelma P. Wray contracted with Respondent for fumigation of her house. No written instructions were given her by Respondent, nor was she advised to remove medicines. She was advised to remove only milk cartons, cheese and open food. The only warning sign placed on front and rear of house during fumigation (Exhibit 4) on November 10, 1974 did not show type of fumigant used and stated house is safe for reentry at 10:30 a.m. December 11, 1974. This sign appeared on the house the evening of December 10, 1974 and was placed only at the front and rear. No notice of this fumigation was provided to the County Industrial Hygienist who maintains records of notices of all fumigations. Neither Mr. nor Mrs. Chaney testified. No one having personal knowledge was called to identify Exhibit 6 and no evidence was offered that Larry A. Donald, Jr. was employed by Respondent and visited the Cheney home without a valid identification card. Mrs. Ruby Moser did not testify. No witness was produced to testify regarding Phillip Jones' visit to the Moser home on June 10, 1975 or identify Exhibit 7. Neither Mr. nor Mrs. Donald R. Seldes testified. No evidence was presented regarding the alleged visit of Bill Gillian, while an employee of Respondent, to the home of the Seldes. Judith Bashline was contacted by Respondent through telephone solicitation for special pest cleanout and termite inspection. One man sprayed for the pest cleanout and he was followed by Phillip Jones and Ken Ely, Jr. who, after inspecting the attic, advised her she had an infestation in the attic in a dormant state which needed immediate treatment. She entered into a contract for spot treatment for $190. After Jones and Ely left Mrs. Bashline began having misgivings and called another pest control company for information. She was referred to HRS and there contacted David Jones who inspected the property. Upon inspection Jones found no evidence of active infestation - only the preprocessed type damage found in the other homes. When Helen M. Hopper purchased her home at 1037 - 12th Street North, St. Petersburg, Florida she acquired a subterranean termite policy from Respondent. She then started monthly sprayings with Respondent. After the first spraying on September 16, 1975, Ken Ely, Jr., an employee of Respondent, went into Hopper's attic and told Mrs. Hopper she had borers in the roof and needed immediate treatment to save the roof. After he left she called another pest control company for verification. When that company inspected the attic they reported no problem with borers. She then called HRS and David Jones inspected the premises October 24, 1975 and in the attic he found only old damage which had occurred before the wood was processed. There was no infestation for which treatment was indicated. When Donald R. Bond II and his wife purchased a home his mother recommended they use Gulf Coast Pest Control. In January, 1977 Robert R. Plowman, an employee of Respondent, advised the Bonds that they had powder post beetles and dry wood termites and the attic needed to be treated. He came back that evening when Mr. Bond was home and a contract for the work was signed. The following day Mrs. Bond had two other pest control companies inspect the house. Whey they advised her there was no evidence of active infestation she cancelled her contract and called HRS. On February 10, 1977 David Jones inspected her property. He found no evidence of borer or termite infestation; however Jones did find evidence of rat infestation. On June 26, 1976 Robert R. Plowman, an employee of Respondent, inspected the home of Rita M. Spera at 9783 - 52nd Avenue North, St. Petersburg, Florida and reported to her that there was an infestation of wood borers in the attic and she needed to have fumigation. The previous year the Speras had replaced the shingles on the roof and had found the wood in good condition. Accordingly Mrs. Spera really didn't believe Plowman and called HRS for verification. When David Jones Inspected the house on July 2, 1976 he found only evidence of old damage that had occurred before the wood was processed. No evidence of active infestation was observed. Mrs. Ellen M. Hameroff received a telephone solicitation from Respondent for a cleanout and termite inspection. She accepted the offer and on September 2, 1976 Robert R. Plowman, an employee of Respondent, inspected her attic and reported that powder post beetles were present and treatment was needed which would cost $200 to $400. Plowman returned that evening to talk with Dr. Hameroff but they didn't sign a contract. The following day another pest control company was contacted for an inspection. They reported no infestation. She then called HRS and on November 22, 1976 David Jones inspected the property and found only evidence of old damage. On September 1, 1977 William C. Bargren, Scott Askins and F. R. DuChanois, Entomologists with HRS inspected the Hameroff property. They found evidence that pine sawyer beetles had been in the tree from which some sheathing boards in the attic had been processed. There was no evidence of infestation in the Hameroff home. In December, 1976 Robert L. Dill had a spray and free inspection by Respondent on his home at 1551 Citrus Street Clearwater, Florida. Following an inspection of the home, Robert R. Plocnan and John D. Lucas, employees of Respondent, advised Dill that he had powder post beetles in the attic, ceiling and floor under the house and needed treatment. Before agreeing to the treatment for the powder post beetles and preventive treatment for termites for which Respondent wanted $500, Dill had two other pest control companies inspect the property. Both of these companies advised Dill he had no infestation. Jimmy Robinson of Exterminator Terminix, International, a certified operator, inspected the Dill property on November 22, 1976 and found no evidence of powder post beetles or termites for which treatment was indicated. He noticed no damage to floor but did see some evidence of borers before the wood was processed. When Dill reported the incident to HRS, David Jones inspected the property on January 20 and 26, 1977, the second time in company with the Casales, Plowman and Donald. Damage to wood in the floor was done before the lumber was processed and no infestation was present for which treatment was indicated. Lawrence A. Donald, an employee of Respondent, holds a certified operator's license and he found evidence of "tremendous damage due to boring animals" under Dill's house. He opined that there were live larvae in the wood, however, his credibility and expertise left a great deal to be desired. During a monthly contract spraying Robert R. Plowman, an employee of Respondent, told Mrs. Shirley I. Bond that she had powder post wood borer beetles in the attic of her home at 6701 - 19th Street North, St. Petersburg, Florida and needed to have the attic power dusted. Mrs. Bond gave Plowman a check for $295 but after her daughter-in-law's experience, stopped the work. She called HRS and David Jones inspected her property on April 14, 1977. He found no evidence of infestation and in Jones' opinion the power spray of Dridie (a trade name for silica gel) would not be appropriate to treat dry wood termites or powder post beetles. Raymond L. Jackson employed Respondent for the advertised "clean-out" and free inspection. On January 6 and 7, 1977 Robert R. Plowman, an employee of Respondent, inspected Jackson's property at 6243 - 6th Avenue South, St. Petersburg, Florida and advised Jackson that he had active termites and powder post beetles and needed treatment. Jackson signed a contract and paid Plowman $300 for the work. About two weeks later two men power dusted Jackson's attic. After reading an article in the newspaper about powder post beetles Jackson called HRS and his property was inspected by Askins on July 26, 1977 and by Askins and Bargren on August 10, 1977. The only evidence of damage they found was that caused by turpentine beetles prior to the wood being processed. In their opinion no treatment was indicated before the power dusting was done. Mrs. Helen Stambaugh had a "clean-out" and free termite inspection in July, 1977 at her home at 2518 - 67th Avenue South, St. Petersburg, Florida by Respondent. Larry D. Brown, an employee of Respondent, to whom an application for identification card had not been submitted, told Mrs. Stambaugh that dry wood termites were infesting her garage and treatment was necessary. Spot treatment was offered for $130. She contacted another pest control company who, after inspection, advised that no treatment was indicated. She then called HRS and on July 20, 1977, Bargren and Askins inspected her property and found only evidence of old turpentine beetle damage in the garage which had occurred before the wood was processed. No infestation for which treatment was indicated was observed. In October, 1975 representatives from Gulf Coast Pest Control, Louis Casale, the company manager, Carmine Casale the owner and Gilbert Bellino, the certified operator, met with HRS representatives in Jacksonville to discuss the numerous complaints HRS had received about Respondent and to formulate remedial action. At this meeting the need for additional training of their salesman was discussed in connection with the complaints filed by Green, Rankin, Wray, and others with particular emphasis on the need to train their operators to distinguish old damage in the preprocessed tree from damage requiring correction. Respondent agreed to increase their training to improve the quality of their inspectors. Respondent has discharged all of the salesmen who made the misrepresentations noted above. Plowman was finally discharged because "he was too dumb" to learn to distinguish between old damage not requiring treatment and new damage which did require treatment. However, Plowman was continued as an employee even after criminal charges involving fraudulent misrepresentation had been filed against him.
Findings Of Fact James Dale Cooley, Respondent herein, is a certified pest control operator doing business as Tropical Pest Control and Closing Inspection Services Company. On December 6, 1990, Respondent inspected a residential property located at 1222 Stimson Street, Jacksonville, Florida, and issued a Wood- Destroying Organisms Inspection Report, HRS Form 1145. That report indicated that wood fungi was present in the subfloor and was caused by a moisture condition in the crawl space. The block under "Report of Findings" on that report for "visible evidence of wood-destroying organisms observed" was marked, "Yes." Under "comments," Respondent stated "Mature home; minor deterioration bottom of siding and trim of detached utility." Subsequently, Respondent issued a second Wood-Destroying Organisms Inspection Report for the same residence, bearing an inspection date of December 7, 1990. The second report indicated that no visible evidence of wood destroying organisms was observed. The "comments" portion was modified to read, "mature home has moisture condition in crawl space, common problem may be considered minor." The issuance of the second report clearly contradicted the first report as to existence of damage from wood-destroying organisms. The property was subsequently purchased based on the report of findings dated December 7, 1990. Mrs. Robinson, the realtor who commissioned the Respondent's inspection and report, testified that this second report was seen by the buyers and co-signer, and probably by the mortgagor, but that the earlier one was not. Eleven months later and after an above-average period of rainfall, on November 25, 1991, an HRS inspector visited the subject property and determined that evidence of damage caused by wood decay fungi was present in the substructure area. The primary cause of wood-destroying fungus growth is moisture. During this on-site investigation, Respondent was cooperative with the HRS inspector and provided him with a copy of his December 6, 1990 report. Receipt of a copy of the earlier report signalled to the department that there had been possible fraud in the sale of the house. Departmental personnel reached that conclusion because the first report had stated that there were wood-decaying organisms present, one day later the second report indicated that there were not such organisms present, and eleven months later wood- decaying organisms were found to be present. According to Respondent, when he made his inspection on December 6, 1990, he had observed only mold, mildew, and moisture stains, but no wood destroying organisms. Respondent's explanation for issuing two reports totally contrary to each other was that he intentionally made out a "very objectionable report" on December 6, 1990 showing that "wood fungi" and "wood destroying organisms" were present because he wanted the buyers to be fully informed about what was really wrong with the house and because he felt the "very objectinable report" would induce the buyers or the realtor to phone him, personally. His explanation for why he wrote in "wood fungi" on the first inspection report was that he was trying to signify only "wood fungi" but not "wood destroying fungi" or "wood destroying organisms." Respondent's testimony on this score is contradicted by the first inspection report itself whereon he had checked the box indicating that he had observed "wood destroying organisms." Respondent also had no plausible explanation for why he did not simply make a full and accurate explanation in the "comments" section of the first report. Also, according to Respondent, he filled out the new report not on December 7, 1990 but sometime thereafter around December 10 after receiving assurances from Mrs. Robinson that the buyers had been informed by somebody else of the true condition of the house. Respondent testified that he made out the second inspection report to reflect the truth of what he had seen on December 6th, not to defraud anyone by substituting a "good" report for the previous "bad" report. Nonetheless, Respondent charged $55.00 for the inspection and what he called a false report on December 6 and $25.00 for the "update" which he called a true report bearing the December 7 date. He admittedly did not re-inspect the premises. According Respondent every benefit of the doubt, it is clear from his own testimony that he intentionally falsified one report which ultimately resulted in an unnecessary fee of $25.00 which someone had to bear when the sale of the property was closed. Competent expert and lay testimony are in accord that mildew and mold are not fungi; neither organism is a wood decay fungus; neither organism metamorphoses into a wood decay fungus when exposed to prolonged moisture, and neither organism is an algae. Mr. Phillip Helseth testified competently and credibility that it is commonly understood that if one cites "wood fungi" as the Respondent did on the first wood-destroying organisms report it is commonly understood within the inspection industry to mean "wood decaying fungi." Mr. Helseth's testimony is also credible to the effect that there would be no reason to report "wood fungi" which is not decaying/destroying on such a report. Moreover, the HRS form utilized for both reports explicitly defines "wood-destroying organism" as, "arthropod or plant life which damages a structure, namely termites, powder-post beetles, wood-boring beetles, wood-boring wasps, carpenter bees and wood- decaying fungi." Mr. Helspeth also testified competently and credibly that "wood decaying fungi" constitutes a "wood destroying organism" and that to call mildew and mold "wood fungi" is inaccurate and falls below the standards of the profession. The competent credible evidence as a whole supports a finding that Respondent issued a false report which was not in accordance with good industry practice and standards. Having made that finding of fact, the undersigned may consider his prior disciplinary record (three cases) and has done so for purposes of penalty, only.
Recommendation Upon the foregoing findings of fact and conclusions of law, it is RECOMMENDED that the Department of Health and Rehabilitative Services enter a Final Order finding Respondent guilty of the statutory violations charged in the administrative complaint, and suspending Respondent's Pest Control Certificate No. 2236 in the category of "Termite and Other Wood-Destroying Organism Control" for a period of three months. Findings Of Fact Upon consideration of the oral and documentary evidence adduced at the final hearing, the following facts are found: At all time material to these proceedings, Respondent DiFalco, was employed by Sears Termite and Pest Control (Sears) of Tallahassee, Florida, a licensee as defined in Section 482.021(12), Florida Statues. Although Respondent was an employee of a licensee, Sears, there was no evidence that Respondent was a "certified operator", or an "identification cardholder" or a "special identification cardholder" as defined by Section 482.021(5)(9), Florida Statutes, and Section 482.151, Florida Statutes, respectively. On or about May 31, 1988, Respondent, representing Sears and responding to a request by Dixie Lee Mims (Mims), inspected the residential property of Mims and represented to Mims that her home was infested with subterranean termites and powder post beetles and that control treatment was needed. Subsequently, though Sears, Respondent entered into a contract, number 96232, with Mims for the control of termites at a cost of $875.00 to be paid through Mims' Sears charge account. Respondent advised Mims that the cost for control of the beetles was included in the contract even though such control was omitted in the contract. Subsequent inspection of the Mims' home by an independent pest control firm and by Petitioner's entomologist revealed no visible signs of present or recent infestation of termites or beetles. Roger White, Manager, Sears, based on an additional inspection by Sears worked out a settlement with Mims whereby Mims would be given $500 credit on her Sears charge account and retain her contract with Sears.
Recommendation Upon consideration of the fcregong Findings of Fact and Conclusions of Law, the evidence of record and the demeanor of the witnesses, it is, therefore, RECOMMENDED that Petitioner enter a Final Order dismissing the Administrative Complaint filed herein. Findings Of Fact Billy F. Killingsworth is a licensed pest control operator in the State of Florida. He has been so licensed since 1967. He holds a degree in entomology and agriculture with minors in toxicology and soils. He is a highly qualified expert in the field of pest control. Mr. Killingsworth is the owner and operator of Killingsworth Pest Control Company, Inc., located in Pensacola, Florida. Killingsworth Pest Control engages in the business of the control and eradication of insects and rodents. Mr. Killingsworth and Killingsworth Pest Control employ Respondent, Richard L. Grimmel. Mr. Grimmel is a Pest Control Special Identification cardholder. The cardholder status enables Mr. Grimmel to administer chemicals and other pest control agents and otherwise conduct inspections of property to determine whether a structure is infested with pests. Mr. Grimmel performs his duties under the supervision of Mr. Killingsworth and Killingsworth Pest Control Co., Inc. About two years ago, Mr. Killingsworth purchased an Insecta-scope II Detector (Insecta-scope). An Insecta-scope is a device which enables an operator to listen to various types of insects while the insects are inside the wood of a structure. The main use of an Insecta-scope is to detect wood boring pests while they are still in a structure's wood, but before any evidence of the infestation appears on the outside of the wood. Different types of wood boring insects make different noises and, therefore, an Insecta-scope operator can determine what type of insect may be present in the wood. The Insecta-scope is on the forefront of technology in the detection of wood-destroying pests. If the operator is properly trained, the machine does what it is advertised to do, i.e., serve as a listening device for the detection of wood boring insects. Other than the Insecta-scope, current methods of detection involve a hammer, a flashlight, and a metal probe. Current methods of detection are limited to determining the presence of wood-boring pests after the insects begin to emerge from the wood. With certain types of insects, considerable damage can occur to the wood of a structure before any damage is noticeable on the exterior of the wood. Powder post beetles/old house wood borers have a life cycle of 10 to 15 years. In general, these insects lay their eggs in the pores of wood. The insects eventually hatch and begin eating the wood in which they live from the inside out. The insects do not reach adulthood for about 10 to 15 years. Once they reach adulthood, they chew their way to the outside of the wood, forming an exit hole. The hole generally has a sawdust-like material associated with it known as frass. Old exit holes are dark, and fresh exit holes are of a lighter color. Once the adult insects have exited the wood, it is highly probable that they will lay their eggs in the pores of the wood they have exited and reinfest the same wood. If left untreated, the insects would continuously be exiting the wood. If treated, the exiting would stop, however, the eggs inside the wood would not be affected. The infestation would appear when new exit holes begin to form 10 to 15 years later. In the meantime, the immature insects would be dieting on the wood in which they live. On February 13, 1989, Mr. Grimmel was called by Scott Mudge to inspect a house located at 3812 West Cervantes Street, Pensacola, Florida. The inspection was required in order to sell the house. The house to be inspected was at least 20 to 25 years old and was located close to the water. The house appeared to have a moisture problem. The conditions in the house were very good for powder post beetles/old house wood borers to infest the house, eating the wooden parts from the inside out. In the attic area of the house there was evidence of an old infestation of powder post beetles/old house wood borers. Reinfestation from the old infestation was highly probable. Mr. Grimmel arrived at the house and conducted an inspection of the premises. In the attic, he saw a few fresh exit holes with frass coming out of the holes. When he placed the Insecta-scope on the area of the frass and fresh exit holes, he knocked what little frass there was off of the beam or impacted the frass into the exit holes. Through the Insecta- scope, Mr. Grimmel could hear powder post beetles/old house wood borers inside the beam. Other than the few fresh exit holes and frass Mr. Grimmel saw, there was very little exterior evidence that the infestation was currently exiting the wood. The infestation was reported to Mr. Mudge and an inspection report was given to Mr. Mudge. Mr. Grimmel also posted a notice of inspection adjacent to the crawl space of the house. Mr. Mudge requested that Mr. Grimmel give him an estimate for treatment of the infestation. The estimate was around $975. Due to the treatment's cost, Mr. Mudge desired to get a second estimate for treatment of the infestation found by Mr. Grimmel. He obtained a second inspection of his house from Fireman's Termite & Pest Control (Fireman's). Fireman's inspector inspected the property either the same day as Mr. Grimmel or the next day. The inspector used the current method of inspecting by looking at the wood with a flashlight and tapping on the wood. Insufficient time had elapsed for new exit holes or frass to have formed; therefore, Fireman's found no evidence of an active infestation of wood borers or power post beetles in the structure. Mr. Mudge then filed a complaint with HRS against Respondents. Upon Mr. Mudge's complaint, HRS initiated an investigation and requested Mr. Killingsworth to file HRS Form 1145, Wood Destroying Organisms inspection report. The report includes information on evidence of whether an infestation was discovered and whether notice of the inspection was posted. Mr. Killingsworth reported that evidence of a live infestation had been observed, but inadvertently failed to properly fill in the information regarding the posting of the notice. 1/ The form submitted by Mr. Killingsworth indicated that a notice of inspection had been posted "in person", but failed to indicate where the notice had been posted. None of the information on either HRS Form 1145 or the inspection report to Mr. Mudge was false or incorrect. The failure of Mr. Killingsworth to fill in the information about the notice of inspection was at best a miniscule violation of Chapter 482, Florida Statutes, since the notice was actually posted and the notice information was not relevant to the complaint of Mr. Mudge. Respondents cooperated in every respect with the Department's investigator. The Department's investigator, using the same techniques as Fireman's, did not find any evidence of an active live infestation i.e. he did not see any fresh exit holes or frass. However, as with Fireman's inspection, the Department's inspection occurred too close to the inspection by Mr. Grimmel for new exit holes or frass to form. 1/ Later, on June 13, 1990, Mr. Killingsworth along with Mr. Grimmel, re- inspected the property. Mr. Killingsworth viewed the area of the attic where Mr. Grimmel had reported the infestation. He saw a few fresh exit holes and some frass. Mr. Killingsworth had Mr. Grimmel place the Insecta-scope on the wood. They heard and simultaneously recorded wood borers/powder post beetles chewing inside the wood. The tape recording was presented at the hearing. It is very unlikely that the infestation or the evidence of the infestation had substantially changed in the time period from the initial February inspection to the present inspection. Based on the above facts, neither Respondent made a false report to Mr. Mudge or the Department. While Respondents' methodology may be in dispute, there was clear evidence on which a reasonable person could rely that Mr. Mudge's house was infested with wood borers/powder post beetles. Neither Respondents relied solely on the sounds from the Insecta-scope to make their determination. The evidence demonstrated that the Respondents' methodology comported with the standard practice in the Pensacola area. Therefore, neither Respondents is guilty of filing a false report.
Recommendation That the Department enter a Final Order dismissing the administrative complaint against Respondent, Grimmel, and finding Respondent, Killingsworth, guilty of violating Section 482.161(1)(a), Florida Statutes, and issuing a letter of guidance to Respondent Killingsworth. The Issue Whether Respondent committed the violations set forth in the Administrative Complaint, as amended, and, if so, what penalty should be imposed.
Findings Of Fact Petitioner is an agency of the State of Florida charged with regulating the operation of the pest control industry pursuant to Section 482.032, Florida Statutes. At all times material to this case, Clifford Killingsworth was the owner and Certified Operator in Charge (COIC) of Killingsworth Environmental, Inc., d/b/a Environmental Security, a/k/a KEFL, Inc., a licensed pest control company in Cantonment, Florida. Counts 9 and 11 Counts 9 and 11 of the Administrative Complaint allege as follows: Count 9 During an inspection on July 11, 2003, the Department found that Killingsworth Environmental, Incorporated operated an unlicensed business location at 9100 Hamman Avenue, Pensacola, at which sales solicitations were made and remuneration received. This is a violation of Chapters 482.071(1) and (2), Florida Statutes. Count 11 During an inspection on July 11, 2003 the Department found that Killingsworth Environmental, Incorporated phone numbers terminated in an unlicensed location at 9100 Hamman Avenue. This is a violation of Chapter 5E-14.142(3)(b). Killingsworth Environmental, Inc., d/b/a Environmental Security, a/k/a KEFL (hereinafter KEFL), is physically located at 4141 Pine Forest Road in Cantonment, Florida, and is listed at this address on its application for business license filed with the Department. Cantonment is located in Escambia County near Pensacola, Florida. Two other pest control companies, Environmental Security of Okaloosa, Inc., and Atlas Termite and Pest Control of Cantonment, Inc., are located at the same address. On July 11, 2003, the Department conducted an inspection of a company called Home Services Marketing and Management, LLC (hereinafter Home Services), which is located at 9100 Hamman Avenue in Pensacola. Clifford Killingsworth and Clinton Killingsworth2/ are the managers of Home Services. On March 26, 2002, KEFL entered into a Management and Marketing Agreement with Home Services, executed by Clifford Killingsworth on behalf of KEFL and by Clinton Killingsworth on behalf of Home Services. Since that agreement was signed, the telephone number for KEFL listed in the local telephone directory terminated at Home Services. Home Services also answers calls for Environmental Security of Okaloosa and Atlas Termite and Pest Control of Cantonment, Inc. Through their computer system and caller ID, the Home Services employee knows which company is being called and answers accordingly. Home Services employees do not make "cold calls" to new customers. They receive calls from existing customers. They contact customers with active accounts to set up renewals. They also contact homeowners whose homes were treated during construction and whose initial accounts were with the builder of the home. If a new customer calls, a Home Services employee answers the call, gets the contact information from the potential new client, and then calls the appropriate technician who would then call or visit the potential customer. The appropriate technician is generally determined by the geographic location of the caller. While a Home Services employee might send a preprinted contract to the technician to take to the job site or mail a contract to a customer, Home Services does not enter into any contract to perform pest control services. No pest control trucks or chemicals are stored at Home Services. Home Services also has a payment processing component. Home Services sends bills to pest control customers which instruct customers to make out the check to the appropriate pest control company, not to Home Services. Payments from customers for pest control services are deposited into the account of the appropriate pest control company. No evidence was presented that 9100 Hamman Avenue is an advertised permanent location of KEFL from which business was solicited, accepted, or conducted. After the July 11, 2003, inspection of Home Services, Clinton Killingsworth, Clifford Killingsworth's brother, took steps to get Home Services licensed as a pest control company. Clifford Killingsworth did this because it was his understanding that the Department took the position that Home Services was in the business of practicing pest control services. He employed his brother, Daniel Killingsworth, to be the required licensed person in charge, and contacted several insurance companies to obtain the required insurance. He had difficulty in obtaining the required insurance since Home Services does not offer pest control services. Despite these difficulties, Home Services was issued a license in December 2003. Count 10 Count 10 of the Administrative Complaint, as amended, reads as follows: During an inspection on July 16, 2003, the Department found that Killingsworth Environmental, Incorporated stored pesticides at an unlicensed business location at 1830 Galvez Road, Gulf Breeze, Florida, which is a violation of Chapter 5E- 14.142(5)(f) and (g), Florida Administrative Code. That in addition, the Respondent, Killingsworth Environmental, Inc., regularly parked trucks containing pesticide at that location during nighttime hours, published in the 2002-2003 Bell South Telephone Directory under Pest Control Services in the yellow pages of the telephone directory, a listing for "Environmental Security", a name under which it did business, and its employees received by facsimile daily work assignments that were sent to them at that location. That the Respondent, Killingsworth Environmental, Inc operated an unlicensed business location at 1830 Galvez Road, Gulf Breeze, Florida, in violation of Section 482.071(2)(a), Florida Statutes.[3/] The property located at 1830 Galvez Drive is surrounded by a locked fence and contains a structure. The structure is not enclosed. Both KEFL and Environmental Security of Okaloosa park trucks there overnight. The Department conducted an inspection of 1830 Galvez Drive on July 16, 2003. When the inspectors arrived, the gate to the property was locked and the trucks were locked. They entered the property when pest control employees arrived. On the day of the inspection, the Department's inspectors found unmixed chemicals in the trucks. Clifford Killingsworth acknowledges that at the time of the inspection, company trucks parked at the Galvez Drive location overnight and pesticides were in the locked trucks. Company records or contracts are not stored at the Galvez Drive location. No customer contact takes place at or from the Galvez Drive location. The Pest Control Business License Application Form contains a space in which the licensee must respond to the following: "Designate location where pest control records and contracts will be kept and the exact location address for storage of chemicals if other than licensed business location." The applications for business license for KEFL d/b/a Environmental Security do not reference 1830 Galvez Road as a location where storage of chemicals occurs. KEFL does not have a license for operating a business at this location. The yellow pages for the Pensacola area contains a listing in red ink for "Environmental Security, Inc." It lists an address of 4141 Pine Forest Road with the telephone number 473-1060. There is another reference to "Environmental Security" in black ink in smaller type which lists the address 1830 Galvez Drive with the number 916-7731.4/ Clifford Killingsworth arranged to have a phone line for a fax machine to be located in a trailer at the Galvez Drive location. The purpose of installing a fax line at Galvez Drive was for employees to receive daily schedule assignments. The 916-7731 number listed in the yellow pages is the number of the fax machine. Clifford Killingsworth did not request a listing for the number of the fax machine. However, the telephone company listed it in the phone book. Clinton Killingsworth has requested the local telephone company remove the erroneous listing a number of times. Count 13 Count 13 of the Administrative Complaint reads as follows: During an inspection on July 11, 2003 the Department found that pesticide was kept at 4141 Pine Forest Road in a container other than application equipment and not accurately identified through the use of permanent, durable label or tag, showing the common or chemical name(s) of principal active ingredients(s), which is a violation of Chapter 5E-14.106(4), Florida Administrative Code. On July 11, 2003, the Department conducted an inspection of KEFL's business location, 4141 Pine Forest Road. One of the inspectors that day was Bruce Nicely, a regional supervisor of the Department's Bureau of Entomology and Pest Control. He was accompanied by Paul Matola of the Department, who did not testify at the hearing. During the inspection, Clifford Killingsworth opened a storage trailer for inspection. Mr. Killingsworth described the trailer as a jug disposal trailer, where empty jugs and drums were stored until they could be recycled or disposed of properly. At the back of the trailer, Mr. Nicely found a two- and-one-half gallon unmarked jug inside a five-gallon bucket. An unidentified substance was inside the jug. Mr. Nicely took a sample of the substance inside the jug, pouring it directly into an eight-ounce sample jar. He labeled the jar "PHY number 07110346060107" and placed the sample in a sealed sample collection bag which was put in a cooler of ice. When completing the pesticide collection report, he wrote "pesticide screen" in a blank after the words, "List active ingredient(s) and/or compounds to analyze for." Mr. Nicely then gave the sample to Steven Dwinnel, at 4:35 p.m. on July 11, 2003.5/ Mr. Dwinnel relinquished the sample to Mike Page at 8:03 p.m. on July 11, 2003. At the time, Mr. Page was the director of the Department's pesticide laboratory. Mr. Page has an undergraduate degree in chemistry and a graduate degree in toxicology and pharmacology with over 16 years of experience as an analytical chemist. When Mr. Page received the pesticide collection report, the word "Lindane" also appeared on the report along with the request for a pesticide screen. It is not clear who wrote the word "Lindane" on the collection report or when the word "Lindane" was written. According to Mr. Page, a pesticide screen includes testing for Lindane. He therefore concluded that whether or not the word "Lindane" was included in the request for analysis made no difference in the lab's testing. An analysis of the sample was performed revealing that the sample contained a concentration of 34.2 percent Lindane and 46 parts per million of Chlorophyrifos. Mr. Page described the amount of Chlorophyrifos compared to the Lindane as a minuscule amount. Both Lindane and Chlorophyrifos are pesticides. The undersigned is persuaded that the Department appropriately maintained the chain of custody of the sample regardless of whether or not the word "Lindane" appeared on the collection report. The fact that "Lindane" appeared on the collection report sometime after Mr. Nicely relinquished it and the sample is of no consequence as to the validity of the laboratory testing of the sample. Clifford Killingsworth is uncertain as to whether his company ever used Lindane but is certain that they have not used it in recent years as it has been "off the market" since approximately 1999. Two other pest control companies, Environmental Security of Okaloosa, Inc. and Atlas Termite and Pest Control of Cantonment, Inc., also use the trailer from which the sample was taken, to store empty pesticide containers. Clifford Killingsworth does not know if the jug from which the sample was taken belonged to his company. Although he was aware that his company stored empty pesticide jugs in the trailer, he was unaware that a jug in the trailer contained an unidentified substance. When asked under cross-examination what he would have done had he been aware of a jug containing an unidentified substance, he answered that he probably would have called the landfill to see when the next "roundup" would be as that is when the landfill takes "unidentifieds."
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law set forth herein, it is RECOMMENDED that a final order be entered assessing a fine against Respondents in the amount of $2,600. Findings Of Fact An administrative complaint was filed against Respondent Earl W. Adams, a registered real estate broker on July 27, 1977. Respondent holds license no. 0148042. The complaint alleged: That Mildred Muranyi contacted Respondent in May, 1976, for this services to locate investment property. Respondent suggested that Mrs. Muranyi consider the motel business and specifically the Seascape Motel owned by Joseph J. Brex and his wife. That Respondent drafted a contract under which Mrs. Muranyi agreed to purchase the Seascape Motel; that at the insistence of Mrs. Muranyi Respondent Adams placed a provision in the contract relating to termite inspection; that Respondent stated that he would have the Seascape Motel inspected for termites on behalf of Mrs. Muranyi; that at Respondent's request Broker Dorothy Kincel instructed Mr. Ken Treat of Terminix Pest Control to inspect the Seascape Motel; that upon beginning the inspection, evidence of termites and termite damage was found and this information was brought to the attention of Respondent whereupon Respondent contacted Mr. Baughn Kestetter of R.W. Collins Pest Control and requested a termite inspection of the Seascape Motel; that Respondent instructed the pest control agent to inspect only certain units of the Motel; that thereafter Respondent requested a clearance letter from Mr. Kerstetter regarding termites and was thereupon advised that inasmuch as the inspection was incomplete, no clearance letter would be given. That on or about June 16, 1976, Respondent wrote Mrs. Muranyi and advised her that the Seascape Motel had been inspected by Collins Pest Control for termites and no evidence of any infestation was located; that in reliance upon the representations of Respondent Mrs. Muranyi, on July 12, 1976 closed the sale and purchased the Seascape Motel. The Hearing Officer finds: The subject property, the Seascape Motel, was inspected by two termite companies, one company, Ken Treat of Terminix Pest Control began inspection and the inspector found termites present and notified the owner of the property. No Evidence was produced to show that Respondent had notice of the finding of the termites. A second pest control company, R.W. Collins Pest Control, was contacted but could not make a complete inspection of the property for the reason that part of the units were not available to the inspector. The inspector notified Respondent Adams that he could not write a clearance letter inasmuch as all units had not been inspected. The original contract had been changed by the parties to state that the property was sold in "as is condition." A letter of June 16, 1976 from Respondent Adams to the purchaser, Mrs. Milly Muranyi gave notice that no full termite inspection had been made. The Respondent, however, appears to be less than candid inasmuch as the broker stated in part "I would do nothing, I wouldn't do anything else regarding termite inspection prior to closing . . ." It is inconceivable that a person with knowledge of damage that can be done by termites could in good faith state that he would close a deal for himself in which the termite damage was unknown. Mr. Adams has dealt with coastal property which is subject to termite damage and it is good business practice to determine any damage that might be done to any structure before purchased. (a) Petitioner contends: that the representations and activities of the Respondent amounted to a fraud on the purchaser; that once evidence of termite damage to the property for sale was discovered by one firm the inspection was cancelled; that the inspection by the second pest control company was limited to portions of the property that were not infected by termites. (b) Respondent contends: that at the time the contract was signed the property was being bought in "as is condition" and that the contract shows a waiver of the termite clause and was initialled by the parties; that the purchasers were represented by a competent attorney; that the condition of the contract was not predicated upon "termites or not termites" and that the price of the motel had been lowered from the original asking price.
