My family and I would like to know if you receive money from a will, do we have to claim it on our taxes

3 names on deed

my mother, father and sister are all on the deed. My mother passed away. Is the house now split between my father and sister or does my father get my mother's share as he is her beneficiary in her will?

My mom passed away and had payed off the house we lived at. However because she left my dad but did not divorce him she had it put in her aunts name when she bought it so he could not take it. Her aunt passed away several years ago in the UK but left the estate to my mom in her will. I had power of attorney for my mom but she did not make a will because everything else has already been changed into my name. I need to find out how to go about putting the house in my name without having a problem with my dad who she is still married to.

My husband passed away in feb 2008. We were separated for 7 years. In that time he accured a lot of credit card debt, I was not on any of these cards. His bills amount to 40,000.00 to 50,000.00. He had no beneficary on his life insurance policy. So since I am still his legal wife I will receive the money. 50,000.00 policy. Am I responsible for all these bills? There is no assets, we have a house in both names. Can the creditors put a lien on my home? They have threatened to do so.

sorry you have miss understood . i had gaurdianship of kids whos parents died. the aunt was the estate person and when she recieved the kids mother life insurance money for the kids she put it in a cd as myself as gaurdian and no withdrawls without court order or kids turn 18. it is the kids money but i have now adopted the kids do i still have to go to court everytime i want to use some. now i am the parent because of adoption can i do what i see fit with the money sorry i wasn't clear

name of institution holding ira

My deceased sister's husband will not tell me the name of the institution holding an ira for which I am named the beneficiary of this account. How can I get this information?

My father passed a way leaving my sister and I excutors of his estate in his will. He did not leave any instructions on how to provide for his wife/ my mother in this will. He did not mention her by name in any way. We are in the state of Ga.

My husband has been told since the death of his grandfather that he would inherit his fathers share of the family farm! We recently went and got a copy of the will and it says that at the end of my husbands fathers natural life his trust shall terminate and and the trust estate shall be distributed in equal parts to my husbands aunts. My question is can my husband do anything about that or is the will set in stone?

Our dad left the house to us 3 kids. We agreed to sell, listed with agent. A offer was made, two of us agreed to take the offer but the third is saying no. We all three signed the real estate agents contract. The will only states share and share alike. The question is can the two force the third to agree to accept this offer.

When sending a Waiver & Consent form to a person named in a will to sign acknowledging receipt of the bequest, is it necessary to attach a copy of the final probate accounting?

Beneficiary info

My mother was left 1/4 share of her sister-in-laws estate. We were approached by the executor which is the daughter of the deceased, offering my mother to settle for 24,000.00. It was this or she would have to give them 6000.00 the following week for house upkeep. My aunt has only been dead 2 months and the house has a clear deed. the house is probably a 225,000.00 house. My Mother is considering agreeing to this because she is on a fixed income and has no money for upkeep on the house. They also want to remodel the house before trying to see it. Should she agree to this and can she be made to pay 1/4 on repairs or upkeep? It seems the house could be sold as is . We actually have no idea what my aunt has. Is there a way to find this out?

Where do I go to research public records of the property ownership of my parents home?

My mother is deceased and my father wants to sell their home.

I've been lead to believe that my mother's half is to be split between my father, me and my brother's children, (brother is also deceased) because of how the home was purchased back in 1968.

I'd like to find out if that is truly the case. 1. Is it a public record? 2. If so, where do I find the records?

Claim of Common Law Marriage to Deceased

My brother in law & his girlfriend jointly purchased & resided in a home in CT. In 2005 the visited the State of TX staying there less than 1 week. They returned to CT & continued to reside in the same home they occupied prior to the trip to TX. My brother in law passed away suddenly in September of 2006. In October of 2006 during the Probate process his girlfriend filed a claim that they were married by Common Law Marriage. No registration of the alleged marriage was recorded in TX. She is trying to obtain entitlement to his entire estate. Would this be a legal marriage in either the State of TX or CT? I know that CT does not recognize Common Law Marriage in their state but would the State of TX recognize a Common Law Marriage of non-residents visiting their state for such a short time?

Can I use a small estate affidavit?

My mother recently died and I was wondering if it would be ok to use a small estate affidavit to settle her estate. She owned a home but I also own it as we were joint tenants. Other than the house nothing she owned is more than the $100,000 cut off.

I was also wondering if they issue letters of office for a small estate affidavit? I would like to cash my mother's final pension check but my bank tells me I need a letter of office. Do you know if a bank will accept a small estate affidavit to cash checks?

Durable Power of Attorney and Trusts

If someone has a Durable Power of Attorney can they change the terms of a trust for that individual such as naming a different benefiiary?

My father executed a Will in 1996, all typed including the place for the date, after he became ill, the Will was alledgly changed in 1998, eliminating heirs,The document looks strange, the attestation clause is not spaced as the rest of the document and made to fit, it appears so that no additional page was needed, and may have been added after, also the date is handwritten and not in my father handwritting no initals to to confirm, Is the date an interlineation, and would have no effect, and because we can not verifie the date, could the 1996 Will be considered his latest Will.

How can I obtain a copy of a Trust document? Is it a public record? If I am mentioned in the Trust do I have any right to a copy of the document?
