My father passed and he left 2 seperate homes to me. I am the only trustee on the will. How do I go about transfering ownership into my name?

Reading of a Will

Good morning,

Isn't it customary for a person's Last Will and Testament be read or outlined by a Lawyer in front all those named in the Will?

When does it not become necessary for a someone's will to be read?

And if so, how are those named in the will notified that they are to receive an inheritance?

does a will have time limit as to how long it is good for? Do you have to re-do a will every 7 years - or is a will once written good for life?

Joint Tenancy with grantor reserving life estate

My mother, sister and I were granted joint tenancy on my grandmothers property in 1970 with her reserving life estate. She passed away in 2001. Shasta County reassessed for propery taxes in 2001. Shasta Co. (Prop 58/193 Parent child-grandchild transfer reappraisal exclusion) says this law excludes transfers between parents and children from reappraisal. And grand children for the first 1,oooooo cash value. Property is not even close to that amount. My mother granted her 1/3rd to my sister and I in 2005 and Shasta Co reassessed again. In 2006 I bought my sisters 1/2 and now Shasta Co. is reassessing. I have asked for a informal review. I need to know if I should just file an appeal. A appeal has to be filed by Nov. 30. Shasta County has treated this as a transfer of ownership since 2001. They have several different explanations for why they have reassessed: Your grandmother can not give it to you if your mother is alive and Because it was a life estate are just a few. I have asked if it was reassessed in 1970 when the actual transfer occured and have never had any responce. How can they reassess something in 2001 that happened in 1970?

Probate - determining whether natural child has been adopted by someone else.

My brother, a consummate story-teller, apparently married a girl in Reno in 1960 because she was pregnant. He insists that there was a marriage, despite no marriage or annulment records existing.

I ASSUME the child was born in the Reno - the godfather was a Reno Casino Owner/ Manager.

The child was put up for adoption under either of the following scenarios:

1) The mother of the child immediately let her sister and brother-in-law (who were unable to have children) adopt the child (no names known), or

2) The mother was rumoured to have drug overdosed – perhaps as a suicide – and unable to raiser her himself, the father (my brother) became involved in the private adoption placement identified above.

He apparently saw his daughter numerous times in her childhood, with the last contact being approximately 1979 when she was married. She subsequently had two kids, divorced, and remarried.

Washoe County Vital Records say that as my brother’s executor I cannot get the birth certificate for the daughter. Further, adoption records are sealed by the court and can only opened by court order. However, confirming the adoption records would clarify her entitlements as a beneficiary. How can I accomplish this?

Power of Attoney and the responsibilities

An elderly family member in Pennsylvania has asked my mother to be POA for her. She has no money or assets of value. She has no will and not even enough money to cover burial costs. She has an elderly sister left as her immediate family. She does live alone in government assisted housing for the elderly. She has no private insurance and is on Medicare and Medicaid. If something were to happen and a medical decision had to be made, would my mother be responsible for her medical bills?

Roughly a year ago when i was being treated for problems with several medications that had me highly sedated i was tricked into signing documentation that forfeited my rights to receive a trust fund of 100-200k. My question is, due to the fact that i was tricked and taken advantage of because of the medication i was on do the documents i signed hold their significance.

life estate

My mother passes away in March, she died intestate and was married at the time of her death - she owned her house for 20 yrs prior to their marriage. they were married for 2 1/2 yrs. He abandoned her for several months. He then had a stroke and she let him come back - He has paid nothing towards the upkeep of the residence no house payments, electric bills, water , cable, phone etc.. - can he still file for a life estate in the property? Everything in the house was hers before the marriage and he has been back for only a year.

Left off of trust

I am the black sheep of the family, only child from fathers first marrage.

When he died he had a realty trust for his 4 other kids, We got along and worked with each other over the years but I was not on the trust because I could not be controled to do unethical things. 3 of the 4 others are now lying, stealing and destroying the property. My fathers home was left to me in his will. There is a second mortgage on the home with approx. 28,000 left to pay. My sister is the exec. of the will and is telling me that the house will have to be sold because liquid assests of the estate will not cover the mortgage in full. My question is what order are creditors paid in and is this mortgage top priority over med. and other bills. my father had a bankruptcy about a year ago so does not have much new debt and has a retirment fund of $20,000 along with a small life insurance policy. Would the house be sold even if the majority of the mortgage is paid? How could i go about paying the remainder or what other steps could i take to keep the house if his debts exceed the money in his estate? Who does the house belong to legally from the time of his death until probate is completed? I was under the impression that the full amount of the mortgage along with the other bills would be sent into probate and it would take some time to know what is going on. How much does the executive have to notify me of what they are doing with the estate?

My Dad lives in Queens, NY. My father made up a will many years ago and it said that all his assest are to be divided equally amoun his 4 children. A yr and a half ago my brother passed away. joint bank accounts

My father recently died. He had 2 bank accounts and I was listed jointly with him on both. I have been told by both banks that ''right of survivorship'' entitles me to this money...which is about $6000. One bank even sent me paperwork to close the account when they were notified. They other has a loan attached to it so that will need to be taken care of first. I am not on the loan. However, the estate lawyer is telling me that that was an account of convenience and that I am not entitled to this money. The bank disagrees. There is no mention of these accounts in the will.
