The issues in this case are whether Respondent was terminated from a treatment program for impaired practitioners for failure to comply, without good cause, with the terms of the monitoring contract entered into by the licensee, in violation of section 456.072(1)(hh), Florida Statutes (2016),1/ as set forth in the Administrative Complaint; and, if so, what is the appropriate sanction.Respondent's refusal to refrain from nursing practice after she missed three random drug tests was failure to comply with the terms of her monitoring agreement. The fact that no drug abuse was ever shown did not constitute good cause for such failure.
