At issue in this proceeding is whether Petitioner may terminate Respondent's employment as an instructional employee based upon the conduct alleged in the letter titled "Notice of Termination of Employment Contract and Immediate Suspension Without Pay" (the "Notice") from Superintendent of Schools Ed Pratt-Dannals to Respondent dated April 13, 2009.School Board failed to prove by preponderance of the evidence that Respondent strapped a child to a potty chair for several hours on three or four consecutive days.
