The issue before the Florida Land and Water Adjudicatory Commission (Commission) in this proceeding is whether to grant the Petition of the Tampa Palms Open Space and Transportation Community Development District (Petition), to contract the boundary of the Tampa Palms Open Space and Transportation Community Development District (District) by removing 21.59 acres from the 3,151.7 acres of land that comprise the current area encompassed by the District. The local public hearing was conducted pursuant to sections 190.046(1)(f) and 190.005(1)(d), Florida Statutes, for the purpose of taking testimony and public comment and receiving exhibits on the Petition. This report is prepared and submitted to the Florida Land and Water Adjudicatory Commission (Commission) pursuant to sections 190.046 and 190.005 for consideration in its determination whether to adopt a rule amending the boundary of the District as requested by the District.Report to the FLAWAC that the Petition to contract the boundary of the community development district satisfies the statutory requirements in sections 190.005 and 190.046.
