THIS MATTER was heard by the Board of Veterinary Medicine pursuant to Sections 120.569 and 120.57(1), Florida Statutes, on December 2, 2003, in Key West, Florida, for consideration of the Recommended Order entered by Stephen F. Dean, Administrative Law Judge, dated October 14, 2003 (a copy of which is attached as Exhibit A). Petitioner was represented by Charles F. Tunnicliff, Esquire. Respondent was not present nor was he represented by counsel at this proceeding. Upon consideration of the Administrative Law Judge’s Recommended Order, after review of the entire record and having been otherwise fully advised in its premises, the Board makes the following findings and conclusions. FINDINGS OF FACT The Administrative Law Judge’s Findings of Fact are approved and adopted and are incorporated herein by reference. There is competent, substantial evidence to support the Board's findings. CONCLUSIONS OF LAW The Board has jurisdiction of the parties and subject matter of this case pursuant to Sections 120.569 and 120.57, Florida Statutes, and Chapter 474, Florida Statutes. The Administrative Law Judge’s Conclusions of Law are approved and adopted and are incorporated herein by reference. The Board ADOPTS the Administrative Law Judge’s recommendation. This Final Order becomes effective upon its filing with the Clerk for the Department. Pursuant to Section 120.59, Florida Statutes, the Parties are hereby notified that they may appeal this Order by filing one copy of a Notice of Appeal with the Clerk of the Department of Business and Professional Regulation, Northwood Centre, 1940 N. Monroe Street, Tallahassee, Florida 32399-0792, and by filing the filing fee and one copy of the Notice of Appeal with the District Court of Appeal within thirty (30) days of the effective date of this Order.
