Lawsuit
I am required to submit an answer to a summons I received. However, upon reviewing the summons I realized that 1 entire page is missing. The missing page contains most of the general allegation. What am I required to do if I don't have all of the allegations against me?
Re: Lawsuit
You do not state if this is small claims, county court or district court. This makes a difference.
You are filing an answer to the complaint not the summons. Contact the plaintiff and ask them for the complete complaint and determine if you may file a motion to provide additional time to answer, if necessary. If you do not answer in the time required, a default may be requested.
Depending on the court, you should also consider understanding what if any affirmative defenses you have to the allegations. Depending on the court, failing provide affirmative defenses with your answer means you waive those defenses.
An answer to a complaint is significant and you can make plenty of bad decisions that will affect your rights in this suit. Either learn the law and procedure or contact an attorney. Good luck.
