medical malpractice

My baby was given his 6 month immunization shots twice, 6 and 9 month check up. The dr said he accidentally prescribed them instead of his 1 (HepB) shot, that he did not get. Is this grounds for a medical malpractice case?

Re: medical malpractice

You only have a case if there are actual damages due to the doctor's treatment or alleged malpractice. If there are no damages, or even if the damages are minimal, it is not worth pursuing, as you'd spend $5-$10K on experts BEFORE the case could even be filed.
