The COVID 19 pandemic is unprecedented and far reaching into the legal community--especially in these early days. This may help address some preliminary questions
2nd part to child support for a child who is not yours
my step-son is paying child support (state deducted from his paycheck) for a child that is not his. He was married to the mother when she became pregnant (he was in prision at the time) and signed the birth certificate. He is not the biological father. The mother no longer has custody ( her parents do). His wages are being garnished for a child who is not his. He does not live in the same state. What can he do to prove that the child is not his and stop paying for this child? He has limited means especially since the deducation of child support. Please advise.
This was the original question....
Now I find out that the divorce decree was Dissolution of Marriage Without children. She has remarried. Does this help prove that he is not the father.
Car Accident Civil Suit
My life just changed dramatically when I was struck by another driver in an accident. My car is completely totaled, and I have yet to get a rental from the insurance company. Yes, I have injuries, but my biggest concern is now I don't have a car, how do I get to school? I am a full time student and don't have time for a full time job, let alone transportation to get to a job. My question is, do I have any rights to a civil suit to sue this guy if I don't get enough money from the insurance company for a new car?
My child's father has shown no interest I'm being in his sons life whatsoever. My son is 1 and a half now and he is all of a sudden pestering an old coworker and saying he wants to see him.
I attempted to let him be in my sons life when he was still a few months old, on the condition that he would help out financially and he refused saying the child wasn't his, and threatened to have my son taken from me if I pursued child support from him.
Now, he's all of a sudden decided to want to be in his life because he saw a picture of him on a friends Instagram. He has even threatened to show up at my house because "there is not a restraining order" (his words)
I do not trust this man. He left shortly after I found out I was pregnant and we weren't even in a relationship a month before I got pregnant.
There is no legal documentation anywhere that says he is the father.
Can he do anything? Can he get visitations through the courts? I do not want him near my son.
