Can a spouse backup IM conversations in Mozy and then print the IM conversation and use that conversation against the spouse and/or person the IM conversation is with?

If spouses share access to the machine, then pretty much anything that is on it is fair game.
You might consider couples counseling, or mediation around using the computer, if this is a major issue.
