The law states that a sex offender cannot live within 2640 feet of a school, 2000 feet of a park, or 2000 feet of a child care center. What if the offense took place 20 years ago, and has lived in the same home for the past 30 years? Does he have to move?

Read the case John Doe v. Schwarzenegger, 476 F.Supp.2d 1178 (E.D.Cal. 2007). It addressed this very issue and held that the statute with the residency restriction applied prospectively, meaning to people who committed qualifying sex offenses after the date the satute was enacted.
