My wife works at a hotel in the bay area that was forced to shut down because of the shelter in place order she works in the restaurant and they had placed on a 60 day furlough They informed us that our health vision and dental benefits would be expiring at the end of April on April 30 I was wondering if this was legal because it seems as if it wouldn’t be or is it just ethically wrong?
It depends on the terms of the employee benefit plan that your wife belongs to. As unfair as it may be, it is not unlawful for the employer to enforce the terms of the employee benefit plan as long as doing so is not unlawfully discriminatory.
She should be offered COBRA rights to pick up paying for her benefits. It will be more expensive, but it may be worth if it she has any existing medical issues that are expensive.
Good luck to you.
debt collectors
an atty contacted my mom for an overdue balance from breast cancer surgery. she offered to pay what she could afford but he told her she must make 4 very high pmts or go to court. she's trying to afford this but just got a letter stating he's now charging her interest but will waive that if she pays in full immediately. is this legal? she has so many medical bills and is doing the best she can - still working at 70yrs of age to pay them off. i thought that they couldn't force her to make pmts she cannot afford? please help. thank you!
House ownership
We live in Michigan and my boyfriend wants to put me on the deed to his house. I'm worried that since he has a mortgage on the house that I will be also legally responsible to pay the debt. Or will being put on the deed mean that I have part ownership of the house but no legal responsibility to pay the mortgage? I just want to know the the ramifications of doing this? I do understand the bank has a lean on the house until the mortgage is paid back. He already has me on his trust to inherite the house in case of his death.
Injury Misdiagnosis
I recently had a scooter accident on while on a cruise to the Bahamas. The cruise line doctor took no x-rays, determined leg was not broken and diagnosed it as a soft tissue injury. I was given meds and a wheel chair for the remainder of the cruise and was encouraged to try to walk on it. Upon return home, I went to the local ER and was diagnosed with a right leg fracture which required hospitalization (4 nights) and surgery. I am currently receiving disability from work, am on pain meds, and receiving at home PT. I am on crutches and my leg is non-weight bearing (can't walk or drive)until at least 29 Nov, then will involve intense outpatient PT. Do I have a case against the cruise line?
