Can I file bankruptcy if I have assets?
I am considering filing bankruptcy, but I have some assets that may prevent me from doing so. The amount of debt I have outweighs the assets tremendously. My home is currently in foreclosure, and I'm avoiding the repo agent for my vehicle. My assets are property totaling approximately 1/3 of the debt i owe. Can i file bankruptcy,or would I be required to liquidate my assets to pay creditors?
Your eligibility for bankruptcy relief depends on your income and to a certain extent your assets. You may be entitled to exempt some or all of your assets from collection and/or the bankruptcy proceeding. Most bankruptcy attorneys offer free consultations to review your circumstances and determine your eligibility for relief. You should strongly consider contacting an attorney in your area to review your options.
