Child visitation and coronavirus

The answer is no one knows for sure. The custody orders have not been expressly modified by the Governor's or local orders. So if you decide to keep your child in your residence, the risk you run is that down the road the OP will seek to have you held in contempt. However, you have a government order to shelter in place, you have a court system that is shut down and can't give you aid in making a decision and given that the supervisor is not a professional and that people are not supposed to be gathering in goups you have a rational belief that your son would be in more danger of being infected (and would infect fewer people if he is already infected) if supervised visitation goes forward. I find it hard to believe that a judge would find you in contempt in those circumstances, but my view won't necessarily hold up in court. I do recommend that you make arrangements to set up phone calls or video calls with the OP. Also, this is a fast changing area and keep up with developments regarding visitation as much as you can.
