You have to go to trial if you are innocent and the prosecutor and/or police officer who arrested you for the DUI and/or the court refuse to dismiss the case without a trial.
You begin the process by pleading not guilty. Then the case is conferenced to assess the proofs and expert reports. Then either a plea is entered or a trial commences.
NOT all the time if you can convince the prosecutor they do not have a good case, but you will never be able to do this without a good lawyer. Just so you know most DWI's are lost even with lawyers.
