I have work for an Italian Cheese company in Warren, IN. We have a restaurant in Chicago, Il and I have a couple of employees who have E2 Visa's that are from Rome. We had to lay the off can they file for unemployment and not be sent back to Rome?
They have to depart the US as soon as practical as they are no longer in a valid status and began acquiring unlawful presence.
Generally, E-2 employees who are laid off are out of status and not available for unemployment. Why not furlough them instead?
