E2 Visa employee and due to the COVID-19 we have had to "layoff" .

They have to depart the US as soon as practical as they are no longer in a valid status and began acquiring unlawful presence.

Generally, E-2 employees who are laid off are out of status and not available for unemployment. Why not furlough them instead?

No, as soon as you laid them off, they were no longer in lawful immigration status.
