1. Spelled my name wrong - therefore, they were careless. This means they were likely to make other mistakes.
2. Was breathalyzer calibrated?
3. Officer was in training. Had no idea what he was doing. He was nervous and kept asking his trainer what to do.
4. I passed the test with flying colors yet was still taken to jail. They parked my car near the jail. What did they touch in my car without my knowledge?
5. If all I had to do was sit in jail for 6 hours and I was able to keep my car- why couldn’t I have been taken home?
6. What was their reason for pulling me over?
7. I was not swerving. I was almost home - why arrest me and spend time on something small?
9. I was not drunk - .08 is arbitrary. Why do rich people get away with DUIs like that and I didn’t? I wanted a public defender but there are so many obstacles to get one. I received about 5 minutes of time and was pressured to accept the judgement. They were impatient when I tried to ask questions.
Which court and county is the court case out of. What happened at the DMV hearing or did you request one.
Yes depending on when you gave the plea you should be able to retract it and fight your case but need to act fast, - how long has it been.
The fee would be to first to try to retract and re-open your case, should we win and that is allowed, then we can charge you for the DUI defense.
