My boyfriend is in Atlantic County justice facility and is being held with no bail and a probation violation charge. He needs to be home especially with this epidemic going on.
More information is needed. The directive releases people serving municipal court sentences or probation conditions. A VOP is not considered a probation condition unless that was the language of the sentence. If he was sentenced to State Prison he is in a different category. You need to speak to his attorney ASAP who knows the case best.
His situation really stinks ......as the clients whom i have had released are serving county sentences or were not released before on a new pending case. His situation is different in that a VOP will probably subject him to a state prison term depending, of course, on the violation , the prior crime, his record, when he was placed on probation, etc. The fact that there is a pandemic does not qualify him for a release at this point. If, however, he has some underlying illness & there is record of that , immediately contact the county public defender's office as there is a compiled list of people considered for release.Good luck!!!!
Much really depends on what his probation violation was for and the severity of the original crime if it was a violent crime the chance of release is very slim. Offenders who were sentenced to 365 days or less have a good chance of release assuming they pose a low risk threat such as people charged with property crimes, shoplifting etc.
You need to hire a lawyer. We are in contact with the courts and able to do emergent motions based on video. My office has been submitting motions to revisit detention based on factoring Covid exposure especially if inmate is in a high risk group.
