I have my brother’s durable power of Attorney. He doesn’t have a bank account. I spoke to the title company who is the originator of the check & they said the check had to be written to him. What are my options?
You would need to open a bank account for him. Since he can’t be present to open the account, that will cause some difficulties. You should call your bank and see what their requirements are to open an account.
You could possible do a third party endorsement using the PoA and sign it over to you for you to hold for him.
With the coronavirus, I doubt you would be able to go to the jail or prison to have him sign so that is another complication.
Loss of Land
My elderly mother's neighbor has been mowing a large piece of her property for about 3 years now. Is there some loophole where he can obtain ownership by caring for the property? He has mentioned interest in owning it and has actually told other neighbors that he owns it. I am concerned my mother may lose this land. Thank you.
Custodial care of 16 year old
My granddaughter is 16 years old. She lives with her mother who is unstable and is emotiopnally abusive. Her father has only contacted her twice in a year though he lives only a couple miles away. I want to have her live with me as soon as possible. Her mother has moved her over 50 times since her birth.
Inheritance
I share the same apartment with my father, who is old, sick and may die.
He is in divorce with his wife (my stepmother), who threw him out of their jointly owned house, more than one year ago. There is no decision in the divorce case, yet.
My father left me everything he owns, in his last Will -- but if he dies soon, could all be considered common property with his wife?
Is it true (as some have told me) that, if my father dies before the divorce case ends, she will inherit everything, including the belongings in my father's apartment, including my own belongings (since I leave in the apartment and I am not part of the lease)?
How can I protect my own belongings?
