If company makes sales using false advertising and using the system is this consider scam?

That is a breach of warranty and typically quite actionable.

Making false representations about available warranties, in the advertising for a product in order to boost sales would constitute false advertising and possible a violation of California's Unfair Competition Act. You say they are using some kind of "loop hole" so that means that not all the facts are displayed. If this seller is doing substantial business, they may be liable in a Consumer Class Action suit brought against them, which could be a nationwide case. Such a suit always needs one person to act as the "lead" or "named" Plaintiff, this could be you. You should contact a Consumer Law Attorney in your area. There is an association called Consumer Attorneys of California that could refer you to one of their members or you can look for a local "consumer" attorney association or "trial lawyer" association.
