If it can be proved that all of the money belongs to another person or has been derived from an exempt source, a judge may vacate the levy. Exempt sources are Social Security income, unemployment insurance, veterans benefits and public assistance. Pensions are also usually exempt from a bank levy. However, a court will not struggle to determine which funds are exempt and which are not. If funds are deposited into an account from multiple sources, a judge will probably not vacate the levy. Likewise, funds left in an account in the nature of an investment or a reserve might also lose their status as exempt.
