My hubby saw "CAP" arrested@ scene but wasn't asked if he wanted to press charges & he wasn't notified of her court date. Her ins Co conceded the max of 30k BUT wants us to sign a "Release of ALL Claims NOT TO ENFORCE JUDGMENT" against the driver "CAP" & the man holding the policy, "CB". I found that he & "CAP" have MULTIPLE aliases & arrest records across the country. She WAS convicted of DWI 4-26-18 in NC due to THIS arrest--BUT she'd also been charged w/Sim Possess of Sch IV CS (M), reckless driving to endanger & drive wrong way on dual lane hwy--all dismissed!! "CB" & his wife "KPB" sold the place listed as "home" on ins 9/5/18. I've done a LOT of digging on "CAP" & "CB"--BOTH have arrest records in Many states as well as places to run. Hubby has a frozen shoulder DUE TO THIS & is facing surgery. We also KNOW "CB" has assets in LA worth $300k. "CAP" has $1mil in assets in NC. We have an injury lawyer. "CAP" wasn't charged for injuring my hubby. Issue?
What can you do? Really? You need an attorney and you likely have the type of case that personal injury attorney's would likely take on a contingent basis. So go shop around and hire an attorney before this gets mucked up any more than it may already be.
