Saturday at 8:55am my landlord texted me telling me she will be at the property I rent to do weeding and she would help herself into the upstairs part of my unit to inspect an ongoing leak I've had since November that she never took care of (that I don't deem as an emergency at this point because it's been leaking for 4 months with no repair) Our state is current on a stay-at-home order due to COVID-19 and I told her I don't think it's wise to come over because I'm not feeling well. She urged that she will still come over but wouldn't come in the house. I don't want her here at all. Am I allowed to tell her to leave? Would this be considered breach of contract because I wasn't provided 24 hours notice that she'll be on the property? I also told her of my leak in November and she still never fixed it. And she promised electricity to a shed on the property which is why we wanted to move in and we still don't have electricity (over 6 months ago) What are my options now?
The law does not specifically define a set amount of time that a landlord has to give before entering. The law instead says “reasonable” prior notice is required. A twenty-four-hour written notice to the tenant is considered a “reasonable” notice. If the landlord consistently does this to harass you, there could be penalties. You can deny the landlord entry into your unit as long as you do not do it consistently. AS to the leak, if it is making the unit not habitable, you can try to abate the rent. As to the electric to the shed, if it is not in the lease, you do not have legitimate grounds to make the landlord install it.
