I live in the Fayetteville, North Carolina area and signed a lease on a rental home prior to this entire virus outbreak issue. We are to take possession of the key on April 14th. I am very concerned as to what will happen if there is a lockdown in our state or U.S. wide prior to the 14th. What if the current tenant cannot move out or if we cannot pick up the key? Are we still legally responsible for paying rent for a property that we have not taken possession of or a home we cannot occupy because the tenant cannot move out? I have called the realtor a few times already and no response. We already put down the security deposit. We are still living in our current apartment complex
You will only have to pay rent if the home is open and available to you. If the home is not available, the landlord would technically be in breach and could not demand you pay rent.
