I’m in urgent need of help to understand the following situation.
-I’m an F-1 student visa holder who came to study Aerospace Engineering and was supposed to graduate in December but failed two courses. I was supposed to get the grade changes and so I have not been enrolled. I’m currently on post-completion OPT but have not found a job so I have until April 13th to not accrue 90 days of unemployment.
-I have been arrested for 3 charges: DUI, reckless driving and eluding the police. The criminal defense attorney has moved the court dates from March to April and now to June. He has expressed interest in waiving my presence at first but during later conversations said I might need to be there and later said I might not amid the current public health crisis. With the district attorney, the idea was to allow me to undergo a DUI diversion program to avoid the conviction but now apparently the DA wants to convict me of the eluding charge and drop it from felony to misdemeanor.
I’m currently very concerned with overstaying beyond April 13th and will be planning leaving the country soon no matter how hard it is for me to be returning to my home country due to COVID-19.

You can't get OPT if you didn't graduate.
People on first year OPT can be self employed.
DUIs can be very serious in the Portland area if you were arrested in Washington or Clackamas county ... Multnomah is 'so-so'.
Ask your criminal defense attorney to talk to an immigration attorney as-soon-as-possible.
