I pleaded guilty to a DUI in July 1998. I was curious on why I could not be allowed to have that expunged? I pleaded guilty to a bad check I believe either in 1999 or 2000, but have not been in any type of trouble since. I know that both are misdemeanors, so why are they not allowed to be expunged if I chose to seek expungement?
The expunction statute excludes DUIs specifically. DUI is one of the few misdemeanor crimes that cannot be expunged.
