I’ve just been notified, that the mother of my child was drinking and driving. She was with a passenger and the passengers daughter, to go get our daughter off the bus. she crashed into a ditch. She left the accident with the child 7 I think , no medical attention was given or acknowledged . Also leaving the mother of that child, whom took blame and said she was alone driving and crashed and was taken by ambulance to hospital. The child just spoke out to tell the truth two weeks later. What are the charges she’s facing for doing this?, driving drunk, fleeing, and taking a kid from it and forcing her to remain in silence and receiving no medical help. I’m now highly concerned for my own daughters safety? Could I get custody?
Child custody is a complicated matter and generally is not decided by one event. This conduct is important for a judge to consider but no attorney should be able to state if this one event would give you custody. An attorney should only be able to advise you about this matter if you sit down and discuss the entire history of your relationship and both parties parenting skills with the lawyer.
Please be advised that the Courts are generally closed to the public due to the Coronavirus. Emergency matters can be heard but I have doubts about whether the court would consider changing custody on an emergency basis at this time. If you intend to try to change custody based on this incident you should call the court first and discuss how to present this to the court under the current emergency.
I am not sure what the courts are doing about this but you should definitely report it to the police into the department of children and families
Run, dont walk to petition for custody. You needed to do this the day of the incident. Corona virus protocols are in effect, seek out an attorney so your access to the court house is not hindered.
