i won a civil case where someone owes me money. they never showed up for court. i tracked down their address and requested a warrant for the person to show in court. paperwork was filled out with the San Diego Sheriffs dept. to present the warrant. they presented the warrant to the person but failed to inform the court in time of the date set. the court did not have enough time to place the date on their calendar and assign a judge. also, i received a notice from the SD Sheriff's dept. three months after the date they assigned stating that the warrant had been issued. they neglected to inform me and the court in time to take proper action.
do i have a stable case for suing the SD Sheriffs dept. for not following procedure and doing their job correctly? i have been running around for the past 3 years trying to get this person that owes me money (about 9k) in a courtroom, and then the Sheriff's dept. bungles the paperwork.
