Suing a Judge

It is alleged a state court judge clearly denied a parents rights of due process in a custody proceeding, implicating a fundamental liberty interest.

Could there be an arguable basis for filing suit in federal court against the judge seeking declaratory relief only?

All other avenues of appeal were exhausted through the state supreme court, and these constitutional issues were preserved and raised on appeal.

From what I understand the immunity clause does not include some types of injunctive and declaratory relief. Only declaratory relief is not being pled here.

Legally Obtained Evidence

Suppose police were in hot pursuit of a suspect. The suspect went into a stranger's house. The police followed the suspect inside the house stumbling onto some evidence that is in plain view. The evidence is related to a different crime. Are the police able to legally obtain that evidence or would it be excluded?

There is going to be a festival held at a PUBLIC high school in december. This festival is the biggest event of the year at the public school where academic and athletic achievements are acknowledged. To go along with the acknowledgments, the school band has been asked to play seasonal Christmas music such as ''silent night'', ''little drummer boy'' and a few other religiously themed christmas songs. Also during the festival, a teacher has been asked to address the student body and is going to talk about giving thanks to the lord. Although the comments aren't directed towards one denomination, the general theme of the speech was directed towards the Judeo-Christian tradition. If a few students were upset by the religious content of the festival, and the school said that they would definitely continue using the religious content, would the school be violating any constitutional rights assuming that attendence was required by every student? are there any supreme court cases that this kind of festival would fall under?

cannabis persecution

I have discovered it is unconstitutional for the government to persecute the cannabis culture. The constitution describes the importnace of denying the persecution of a group. Cannabis persecution also violates the mission of the constitution by not insuring domestic tranquility or promoting the general welfare.

Congressional Testimony

In light of the recent baseball Congressional hearings, I have the following hypthetical question. Can one make a case for refusing to testify even if given immunity given the fact that testimony almost always is leaked to the public. This is social self-incrimination when it happens and can do irrepairable harm to a witness. I understand that this would probably not be justified in a real trial, but testfying before congress is not a real trial.

Confusion of State

I have a friend who was given a citation for consumption of alcohol. Shes going to school in Oregon and the law there is that you get a fine and lose your license for a month. But she hasn't gained residency in Oregon and only has a California drivers license. My question is, is it possible for the state of Oregon to take her California Drivers License?

2) What codified power does the United States Government hold in enforcing binding obligation of an individual when such was is performed without the individuals knowledge, consent, or when sill a minor below age of 16? ie: signing the SS5 form for another or when for oneself when below age 16.

Note: I've yet to get an answer from my Senator and was referred to the agency level to obtain answers via FOIA request. Am now doing so. Anyone out there care to take on the buracracy and stand for what is right?

DVBE requirements for biding

I am a General Contractor, I bid a job that called for 3% participation in DVBE. The documents stated that we should fill out forms provided and submit with our bid. Their were no forms attached to the specs to fill out. We signed the sheet we read but did not fill out the proper forms as their were none. We were the low bid but now the second bidder is protesting because we did not fillout the proper forms. Should the job be thrown out and re-bid or should the job go to the second bidder who filled out the forms corctly. Evidendtlyt he second bidder is a DVBE contractor, Shehas a minority woman owned busness and is using that to her advantage. What can I do? will I not be awarded the job? CAn I fight it?

Student Loan and wage garnishment

I was recently garnished by the Department of Education for a student loan I received in 1984. At the time of my default there was a six year statute of limitations (20 usc 1091). 7 years After the statute of limitations for my loan had passed, congress amended, 20 usc 1091 , eliminating the statute of limitation.

Is it a violation of the ex post facto clause to impose sanctions on me based on amended law that was enacted after the statute of limitations had passed?

14th amendment law suite

I'm the animal control officer for a mid-sized city. i'm being sued for 10k regarding a dog fighting case I handled. A person no involved in the initial criminal matter--is now alledging I violated his 14th amendment when the court ordered his dog put down. this occured after the suspect who was in possesion of the dog was found guilty. all by court order. the person suing me never proved ownership of the dog-he simply made one phone call to the PD two years ago. he now wan't money for lost wages in dog breeding-which was always for the purpose of dog fighting. can i counter suit? the attorney representing the plaintiff has no grounds and is trying to destroy me professionaly and personnaly.

Not allowed in Bar?

My ex-boyfriend bartends at a popular bar in the town I live. I went to that bar tonite with a friend, didn't cause any trouble but my ex decided he doesn't want me in there. He and his boss pulled me aside and told me that if my ex at any time doesn't want me in the bar, even if I have done nothing, that he can kick me out. Simply for the fact that he doesn't want me in there. Can they do that? All I did was order a drink and go into another room of the bar to play a game with the freind, when my ex came in and told me I had to talk to his boss.
